ORDER:

The petitioners pray for a writ of mandamus declaring the action of 3^rd respondent in interfering with the peaceful possession and enjoyment of the agricultural lands admeasuring Ac.1.83 cents in Sy.No.50-1 of 1^st petitioner, Ac.1.84 cents in Sy.No.50-2 of 2^nd petitioner and Ac.3.67 cents in Sy.No.503 of 3^rd petitioner, situated in Ramavaram Village, Owk Mandal, Kurnool District without any right and without following due process of law due to some political pressure as illegal and arbitrary and for a consequential direction.

2. The case of the petitioners succinctly is thus:

The petitioners are the owners of the aforesaid lands as they have

inherited those lands from their ancestors and enjoying the same. In recognition of their ownership and enjoyment, pattadar passbooks were issued and Adangals also have been recorded in their favour in respect of the subject properties.

3. Heard Sri K.Rathangapani Reddy, learned counsel for petitioners, and learned Assistant Government Pleader for Revenue representing the respondents.

4. Having regard to the fact that the petitioners produced copies of the Pattadar Passbooks and cultivation Adangals for Fasli No.1431 and established their title and possession in respect of the subject properties and as the learned Assistant Government Pleader for Revenue has not produced

any record to prima facie show that it is a Government land, this Writ Petition is disposed of directing the respondent authorities, particularly 3^rd respondent, not to interfere with the possession and enjoyment of the petitioners. If the 3^rd respondent proposes to take any action for eviction of the petitioners, he shall follow due process of law by giving opportunity to the petitioners to submit their objections. No costs.

As a sequel, interlocutory applications, if any, shall stand closed.
