The Writ Petition is filed under Article 226 of Constitution of India seeking to declare the action of the respondent nos.1 and 2 in not stopping the illegal and unauthorized construction being made by the unofficial respondents 3 to 5 in an extent of approximately 180sq.yards in premises D.No.11-15-14, Vinnakotavari Street, Vijayawada-1 adjacent to Southern side boundary of the petitioner’s house without obtaining plan approval or building permission from the respondent nos.1 and 2 and without leaving any mandatory open spaces of set backs, front open space of road margin in utter violation of the Building Byelaws and Rules thereunder and the statutory provisions of the Municipal Corporation Act in spite of the complaints and representation dated 15.3.2021 made to the respondent nos.1 and 2 as illegal, arbitrary and consequently direct the respondent nos.1 and 2 to initiate action for removal of the unauthorized construction of the respondent nos.3 to 5 in accordance with representation of the petitioner following due process of law and stop the illegal and unauthorized constructions made by in the subject property forthwith. 2. As per the averments in the writ petition, the petitioner along with his wife and sons purchased a property in an extent of 111.92sq.yards out of an extent of 149.42sq.yards situated in old D.No.11-15-13, New D.No.11-15-13A along with ground, first, second and third floors RCC building with all fittings, wood fixtures, staircase, balcony, electricity connections, etc. The vendors of the petitioner have obtained building permission from the respondent no.1
