ORDER :

The present Writ Petition under Article 226 of Constitution of India is filed for the following relief:-

“ to issue an appropriate Writ of Mandamus declaring the action of the respondents in trying to occupy the petitioner land and also trying to put the fencing to the boundaries in the land bearing Sy.No.37/1(37) which is situated at Resavanipalem, Seethammapeta Mandal, Greater Visakhapatnam Municipal Corporation, Visakhapatnam District as illegal and arbitrary. ”

The case of the petitioner is that the petitioner is permanent resident of Resapuvanipalem, Visakhapatnam District and she is in peaceful possession and enjoyment of the land admeasuring an extent of Ac.2.00 cents in Sy.No.37/1, Old Patta No.1437, New Patta No.13 of Resapuvanipalem, Visakhapatnam District. Now the 5^th respondent is trying to occupy the petitioner’s land and trying to construct fencing around the land without any permission or notice. Originally the subject land was devolved upon the petitioner after the death of her ancestors. Aggrieved by the action of the 5^th respondent’s attempt to fix the boundaries to the petitioner’s land, the present Writ Petition is filed.

During hearing, learned counsel for the petitioner limited his request to dispose of the representation made by the petitioner dated 25.02.2021 and the learned Government Pleader for Revenue readily agreed for the same.

The petitioner though claiming that she is in possession and

enjoyment of the subject property has not produced any documents to substantiate her contention, but placed on record, the representation dated 25.02.2021 submitted by the petitioner to the District Collector, Visakhapatnam.

In view of the limited request made by the learned counsel for the petitioner, the Writ Petition is disposed of directing the District Collector, Visakhapatnam/2^nd respondent herein to dispose of the representation submitted by the petitioner dated 25.02.2021, in accordance with law, within the period of four(4) weeks from the date of receipt of copy of this order. No costs.

Miscellaneous petitions, pending if any, shall stand closed.
