ORDER:
The Writ Petition is filed under Article 226 of the Constitution of India seeking to declare the action of the respondents in not considering the objections of the petitioner dt.04.11.2013 while passing orders of shifting of premises to the 5th respondent (2-B licensee) as illegal, arbitrary and consequently to direct the respondents to consider the same before passing orders of shifting taking into consideration of circular of 2nd respondent dated 31.10.2013.
During the course of hearing, the learned Counsel for the petitioner and learned Government Pleader for Excise submit that the matter pertains to shifting of 2-B licensee and in view of the changed policy, nothing survives in the matter and no further orders are required and the same became infructuous.
Accordingly, the writ petition is dismissed as infructuous. No costs.
As a sequel, all the pending miscellaneous applications, if any, shall stand closed.
