C.R.No.5881/2020/CPE/E3 dated 03.02.2021 directed the 3rd respondent to take further action. The 3rd respondent vide proceedings R.C.No.463/2017/B1, dated 05.02.2021 directed the 4th respondent to take further action and to report compliance. The 4th respondent directed the prohibition & excise Inspector, A.P.S.B.C.L. I.M.L.Depot, Nallapadu, Guntur to submit report and on 10.02.2021 the said Prohibition & Excise Inspector submitted a report to the 4th respondent and the said report was forwarded to the 2nd respondent. In view of the above, the petitioner has complied all the formalities stipulated as per rules. Despite repeated requests the same was not attended by the authorities and the authorities have not passed orders as per Rules 2017. Hence the writ petition. 4. Learned Counsel appearing on behalf of the petitioner has also relied on the report submitted by the Prohibition & Excise Superintendent to the Commissioner Prohibition & Excise, Vijayawada who is the 2nd respondent herein. In view of the same, the report submitted by the concerned authorities, the 2nd respondent who is the competent authority as per Rules has to consider the report and pass order for shifting of the petitioner’s trade license from the existing premises to new premises bearing Door No.135-41 and 135-42 at J.K.C.College Road, Guntur. 5. Learned Government Pleader for Prohibition & Excise appearing on behalf of the respondents, on instructions, has submitted that after receipt of the report from the concerned Superintendent, the authorities have received certain objections from the local public and a P.L.C. is also pending before the Deputy Legal Services Authority, Guntur.
