The present Writ Petition, filed under Article 226 of the Constitution of India, calls in question the endorsement bearing Appeal Roc./B/E-22/2021 dated 03.02.2021, issued by the Deputy District Election Authority and Revenue Divisional Officer, Chittoor, respondent No.5 herein. For the post of Sarpanch reserved for Amudala Gram Panchayat, Palasamudram Mandal, Chittoor District, election was conducted. Petitioner No.1 herein submitted her nomination, so also respondent Nos.8 and 9. According to the petitioners, respondent Nos.8 and 9 do not belong to Scheduled Caste and belong to Christian Community, which falls under BC-C Category. It is stated in the writ affidavit that at the time of nomination, the petitioners herein brought the said aspect to notice of respondent No.6-Returning Officer, but respondent No.6 did not choose to consider the same. Assailing the acceptance of the nominations of respondent Nos.8 and 9, the petitioner herein filed an Appeal before respondent No.5-Revenue Divisional Officer. The Revenue Divisional Officer, by way of the impugned endorsement dated 03.02.2021, declined to consider the said Appeal by saying that the appeal would lie only against the rejection of the nomination papers, but not against the acceptance of the same.
