THE HON’BLE SRI JUSTICE CHEEKATI MANAVENDRANATH ROY CRIMINAL PETITION No.4561 of 2021

ORDER:-

This Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 (for short “Cr.P.C.”) is filed seeking quash of F.I.R in Crime No.244 of 2019 of Mangalagiri Town Police Station, Guntur District, registered for the offences punishable under Sections 498-A, 509 IPC and under Sections 3 and 4 of the Dowry Prohibition Act.

The petitioners have also filed petition under Section 320 Cr.P.C to compound the offence stating that both the parties have entered into compromise outside the Court.

At the time of hearing, learned Additional Public Prosecutor would submit, on telephonic instructions, that the entire investigation is completed and that charge sheet is also filed in this case in the trial Court.

If that be the case, as the charge sheet is now filed in the trial Court, since the offence under Section 498-A IPC is compoundable with the permission of the Court under Section 320(2) Cr.P.C, the petitioners have to approach the trial Court and file appropriate application before the trial Court to permit them to compound the offence, by following the procedure laid down in Section 320(2) Cr.P.C.

Therefore, this Criminal Petition is disposed of with a direction to the petitioners to approach the trial Court to file a petition to compound the offence.

Miscellaneous petitions, if any pending, in the Criminal Petition, shall stand closed.
