ORDER :

Heard Sri Mangena Sree Rama Rao, learned counsel for petitioner, learned Government Pleader for Assignment representing respondent Nos.1 to 4 and Sri I. Koti Reddy, learned Standing Counsel, representing respondent No.5 and with their consent, this Writ Petition is disposed of at the admission stage.

The petitioner’s case is that he was granted house site patta vide R.F.B/453/2008, dated 03.10.2008 for an extent of Ac.0.02.½ cents by the respondent No.3 and the petitioner raised a thatched shed and residing therein. However, of late, the respondent authorities are trying to dispossess him without issuing any prior notice, conducting enquiry and following due process of law.

3. Learned Government Pleader for Assignment on instructions, would submit that no such attempt as alleged by the petitioner has been made by the respondent authorities and if they propose to resume the house site patta from the petitioner, they would certainly follow the due process of law.

4. Recording the above submission, this Writ Petition is closed, however, with an observation that in case, in future, the respondents propose to resume the house site patta of the petitioner, they should

strictly adhere to the due process of law. Till such exercise is undertaken, they should not interfere with the petitioner’s house site.

5. Accordingly, this Writ Petition is closed. No costs.

As a sequel, Interlocutory Applications pending, if any, shall

stand closed.
