Heard Sri S.Syam Sunder Rao, learned counsel for petitioner, and learned Government Pleader for Assignment representing the respondents, and having regard to their respective submissions this writ petition is disposed of at the admission stage.

The petitioner’s case is that the petitioner is an assignee under DKT patta in respect of the land to an extent of Ac.1.20 cents situated in R.S.Nos.262/4 & 262/5 in Kaikaluru Village & Mandal, Krishna District and has been in effective possession and enjoyment of the same, but of late the respondent authorities are making hectic efforts to dispossess the petitioner and allot the said land to houseless poor. No prior notice has been issued to the petitioner and no enquiry has been conducted.

Dispelling the apprehension of the petitioner, learned Government Pleader for Assignment, on written instructions, would submit that though the subject land is fit for granting house site pattas as of now, the respondents have not made any proposals for resumption of the land from the petitioner for allotment to houseless poor and in that view, this writ petition is a premature one.

4. Recording the above submission of the learned Government Pleader, this writ petition is closed as no orders are required at this

stage, however, with an observation that in case, in future, if the respondent authorities propose to resume the assigned land from the petitioner, they should follow due process of law. Till then the respondents shall not meddle with the possession and enjoyment of the petitioner in respect of the land to an extent of Ac.1.20 cents situated in R.S.Nos.262/4 & 262/5 in Kaikaluru Village & Mandal, Krishna District. No costs.
