ORDER :
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
“to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus to declare the action of the respondent authorities in proposing to assign house site plots in the land situated in R.S.No.62/1, 63/1, 92/2 and 95/1B to an extent of Ac.1.51 cents Ac.1.59 cents Ac.1.53 cents and Ac.0.30 cents respectively situated at Gopuvanipalem village, Pamidimukkala Mandal, Krishna District, which is classified as Donka Poromboke by changing the classification/Nature of the land as Assessed Waste Lands, which is situated in the midst of the agriculture lands belonging to the petitioners and abutting the Pathway and agricultural water channel, in spite of the objections raised by the similarly situated farmers through their representations dt.16-12-2019, 18-12-2019, 6-1-2020 and 20-12020 followed by personal visits, as being illegal, arbitrary, unjust and unconstitutional, against to the principles of natural justice and contrary to the provisions of Board of Revenue Standing Orders and consequently direct the respondent authorities to drop the proposal of the allotment/assignment of house sites including the conversion/ classification of the land from Donka Poromboke to Assessed Waste Land, and to grant such other relief.....”
Learned counsel for the petitioners and the learned Government Pleader for Revenue submit that the issue involved in this petition is squarely covered by the order of this Court in Writ Petition No.21386 of 2019 dated 04.02.2020.
In view of the submission of the learned counsel for the petitioners and the learned Government Pleader Revenue, this petition also stands allowed in terms of the said order. No costs.
