WRIT PETITION (PIL) No.182 of 2017

ORDER: (per Hon’ble the Acting Chief Justice)

The present writ petition is filed in the nature of Public Interest Litigation seeking the following relief:

“For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon’ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of writ of Mandamus,

(a) declaring the action of respondent No.2 in awarding the contract for supply, installation, commissioning and testing of central air conditioning and lifts in the premises of respondent No.2 on nomination basis as arbitrary and illegal; and

(b) direct a central investigation agency to conduct an enquiry into the supply, installation, commissioning and testing of central air conditioning and lifts in the premises of the 2^nd respondent on nomination basis and prosecute the persons responsible for the same; and

(c ) restraining the 2^nd respondent from awarding the contract for running the canteens in the premises of the 2^nd respondent on nomination basis and pass such other order or orders as this Hon’ble Court may deem it fit and proper in the facts and circumstances of the case.”

When the matter is taken up for hearing, it is represented that reliefs (a) and

(b) have already been worked out.

Insofar as relief (c) is concerned, learned standing counsel for the 2^nd respondent has placed on record letter dated 30.07.2019 addressed by the Administrative Officer, RGUKT, Nuzvid, Krishna District, wherein it is stated that in XXX E.C. Meeting held on 09.07.2019, for according permission to float tenders for providing catering services including maintenance of kitchen and dining halls at RGUKT, Nuzvid, the same shall be permitted by floating tenders through E-Procurement System with revised menu by considering nutrient values. It is also stated therein that RGUKT, Insitute, Nuzvid finalized the mess menu and

the tenders shall be floated within two weeks through E-Procurement with paper

notification ensuring nationwide open competition.

In that view of the matter and in view of what has been stated in the aforesaid letter, no further orders are necessary in the present writ petition and the same is closed.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
