यािचकाकतार् के िवद्वान अिधवक्ता श्री िजतेन्द्र बहादुर िसह एवं िवद्वान स्थायी अिधवक्ता श्री आशीष सक्सेना को सुना।

भारतीय संिवधान के अनुच्छेद 226 के अंतगर्त प्रस्तुत इस यािचका द्वारा यािचकाकतार् ने िजला मिजस्ट्रेट , बाराबंकी के आदेश िदनांक 07.02.2026 की वैधता को चुनौती दी है िजसके द्वारा यािचकाकतार् के ग्राम प्रधान , ग्राम पंचायत शाहपुर , िवकास खण्ड - फतेहपुर , जनपद बाराबंकी के प्रशासिनक एवं िवत्तीय अिधकार उत्तर प्रदेश पंचायत राज अिधिनयम 1947 की धारा 95 (1) ( छ ) के अंतगर्त प्रितबंिधत करते हुए यािचकाकतार् के िवरुद्ध अंितम जांच संपािदत करने के िलए िजला अिधकारी , बाराबंकी एवं सहायक अिभयंता ग्रामीण अिभयंत्रण िवभाग को जांच अिधकारी नािमत करते हुए 15 िदवस के अंतगर्त आख्या प्रस्तुत करने का िनदेर्श िदया गया है। उपरोक्त आदेश की वैधता को चुनौती यािचकाकतार् ने इस आधार पर दी है िक आदेश यािचकाकतार् को सुनवाई का अवसर प्रदान िकए िबना पािरत िकया गया है।

आदेश िदनांक 07.02.2026 में यह अंिकत है िक शपथ - पत्र से समिथत िशकायतों के आधार पर यािचकाकतार् के िवरुद्ध स्थलीय / अिभलेखीय जांच िजला उद्यान अिधकारी , बाराबंकी , सहायक अिभयंता , लोक िनमार्ण िवभाग , बाराबंकी एवं िजला लेखा परीक्षा अिधकारी ( सहकारी सिमितयां एवं पंचायत ), बाराबंकी से कराई गई। जांच आख्या के क्रम में िदनांक 27.11.2025 को यािचकाकतार् को उत्तर प्रदेश पंचायत राज अिधिनयम की धारा 95 (1) ( छ ) के अंतगर्त नोिटस िनगर्त करते हुए वषर् 2024-25 गौशाला शाहपुर में शासनादेश में िनिहत व्यवस्था के िवपरीत डीजल हेतु रुपए 1,83,673/- एवं रुपए 16,300/- का भुगतान करने व वषर् 2021-22 में इण्टरलॉिकग व िमट्टी िगराई कायर् हेतु रुपए 1,921/- का भुगतान करने एवं गौशाला व ग्राम पंचायत में ह्यूम पाइप क्रय करने के नाम पर रूपए 33,246/- का अिनयिमत तरीके से आहरण करने व ग्राम पंचायत में एल०ई०डी० बल्ब क्रय / इस्टॉलेशन के सापेक्ष रुपए 1,18,800/- की शासकीय धनरािश का िनयम िवरुद्ध व् य िकए जाने के संबंध में स्पष्टीकरण प्रस्तुत िकए जाने का िनदेर्श िदया। यािचकाकतार् द्वारा स्पष्टीकरण न िदए जाने पर उपरोक्त आदेश पािरत िकया गया है।

यािचकाकतार् के िवद्वान अिधवक्ता का कथन है िक कारण बताओ नोिटस प्राप्त होने पर यािचकाकतार् ने नोिटस में अंिकत जांच आख्या की प्रित मांगी थी। िदनांक 30.01.2026 को िजला पंचायत राज अिधकारी ने यािचकाकतार् को पत्र िलखकर यह कहा िक इस न्यायालय के िनणर्यों के अनुसार प्रारंिभक जांच की आख्या की प्रित उपलब्ध कराना उिचत नहीं है। यािचकाकतार् के अनुसार उसको यह पत्र िदनांक 04.02.2026 को प्राप्त हुआ एवं िदनांक 07.02.2026 को आदेश पािरत िकया गया।

यािचकाकतार् को कारण बताओ नोिटस प्राप्त होना स्वीकार है। प्रारंिभक जांच आख्या की प्रित प्राप्त न होने के आधार पर यािचकाकतार् ने कारण बताओ नोिटस का उत्तर नहीं िदया। इस यािचका में यािचकाकतार् ने कथन िकया है िक डीजल का क्रय फसलों की िसचाई एवं गौशाला में प्रकाश व्यवस्था के िलए िकया गया था तथा यािचकाकतार् डीजल क्रय की रसीद जो ग्राम िवकास अिधकारी द्वारा सत्यािपत है प्रस्तुत करेगा। यािचकाकतार् के िवद्वान अिधवक्ता ने डीजल क्रय की रसीदों की प्रितयां न्यायालय के समक्ष प्रस्तुत की िजन सभी में मात्र यािचकाकतार् ग्राम प्रधान का हस्ताक्षर है एवं ग्राम िवकास अिधकारी का हस्ताक्षर नहीं है। एल०ई०डी० लाइट क्रय की रसीदें भी यािचकाकतार् के िवद्वान अिधवक्ता ने न्यायालय के समक्ष रखी एवं यह भी ग्राम िवकास अिधकारी द्वारा सत्यािपत नहीं है। ह्यूम पाइप से संबंिधत रसीदें भी ग्राम िवकास अिधकारी द्वारा सत्यािपत नहीं है। उक्त सभी रसीदों की प्रितयां अिभलेख पर ली जाती हैं तथा इसकी एक प्रित राज्य सरकार के िवद्वान स्थायी अिधवक्ता को प्रदान की जाती हैं जो अंितम जांच आख्या में साक्ष्य के रूप में पढ़ी जाएंगी।

उक्त तथ्यों से यह स्पष्ट है िक यािचकाकतार् अपने िवरुद्ध लगाए गए आरोपों के संबंध में प्रथमदृष्टया ऐसा कोई कथन नहीं कर पाया है अथवा साक्ष्य दे पाया है िजससे आदेश में हस्तक्षेप करने का कोई उिचत आधार नहीं है। तदनुसार , यािचका िनरस्त की जाती है। चूंिक , यािचकाकतार् के िवत्तीय एवं प्रशासिनक अिधकारों पर रोक लगाई गई है एवं उसके िवरुद्ध अंितम जांच की कायर्वाही लंिबत है , जांच अिधकारी को यह िनदेर्श िदया जाता है िक जांच की कायर्वाही शीघ्रतापूवर्क , यथासंभव आज की ितिथ से 30 िदन के भीतर पूरी करके जांच आख्या प्रस्तुत की जाए िजसके आधार पर िजला पंचायत राज अिधकारी / िजलािधकारी िविधनुसार अिग्रम कायर्वाही करना सुिनिश्चत करेंगे। March 11, 2026 Sumit
