The petition followed a co-ordinate Bench direction dated 17.03.2025 in Writ - A No. 3216 of 2025 to the District Inspector of Schools; the matter was then referred to the Deputy Director of Education (Secondary), Varanasi Range, who relegated it back to the District Inspector of Schools. At the very outset, learned counsel for the petitioner has prayed for and is permitted to correct the details of the respondent No. 2, during the course of the day.

Heard learned counsel for the petitioner, learned Standing Counsel representing State-respondents and perused the record on board.

This writ petition has been filed, inter alia, seeking following reliefs:

"i) issue a writ, order or direction in the nature of certiorari quashing the order impugned dated 28.01.2026 (Annexure No.1 to the writ petition) passed by Deputy Director of Education, Varanasi Region, Varanasi.

ii) issue a writ, order or direction in the nature of mandamus commanding and directing the Deputy Director of Education, Varanasi Region, Varanasi to consider the claim of petitioner and pass appropriate order with regard to family pension of petitioner forthwith."

It is submitted that a co-ordinate Bench of this Court, by order dated 17.03.2025 passed in Writ - A No. 3216 of 2025, issued a direction to the District Inspector of Schools to decide the representation of the present petitioner with regard to the release of the family pension and other financial benefits. Pursuant thereto, the District Inspector of Schools, referred the matter before the Deputy Director of Education (Secondary), Varanasi Range, Varanasi treating him to be the competent authority. However, the Deputy Director of Education (Secondary), in turn, relegated the matter to the District Inspector of Schools to take a final decision on the representation in the light of the order passed by this Court.

It is amazing that both the authorities are shifting the responsibility onto each other and appear to be uncertain as to who is the competent authority to decide the claim of the present petitioner for family pension.
