Heard learned counsel for petitioner and learned State Counsel appearing on behalf of the opposite parties.

Present petition under Article 226 of Constitution of India has been filed challenging charge sheets dated 06.11.2024 and 16.12.2024 as well as notice dated 09.04.2025; show cause notices dated 20.01.2026 and 16.02.2026.

Primary gist of submissions of learned counsel for petitioner is that earlier as well, with regard to the same allegations, charge sheet dated 06.11.2024 had been issued and thereafter a fresh charge sheet dated 16.12.2024 was issued in pursuance of which impugned show case notices have been issued. It is therefore submitted that with regard to same enquiry proceedings, petitioner is being proceeded against twice.

Learned State Counsel has been provided written instructions dated 15.03.2026 and on that basis submits that the initial charge sheet dated 06.11.2024, was in fact initiated in terms of U.P. Police Officers of the Subordinate Rank (Punishment & Appeal) Rules, 1991 but petitioner being only a Civilian employee in the Police Department on the post of Urdu Translator, the said Rules were inapplicable and therefore the initial proceedings initiated vide charge sheet dated 06.11.2024 were withdrawn and a fresh charge

sheet was issued in terms of Uttar Pradesh Government Servant (Discipline & Appeal) Rules, 1999.

However, a perusal of written instructions indicates that findings recorded by authorities dated 25.12.2024 were withdrawn. The instructions do not indicate whether such findings were with regard to charge sheet dated 06.11.2024 or in some other proceedings.

In view thereof, list this case on 25.03.2026, as fresh, in order to enable learned State Counsel to obtain specific instructions as to whether proceedings initiated in pursuance of charge sheet dated 06.11.2024 were withdrawn or are still continuing.
