Learned counsel for the petitioner submits that in compliance with the order dated 29.01.2025 passed in SLP No. 18516 of 2019 (State of U.P. and Others vs. Neeraj Kumar Pandey and others), the claim of the candidates, who were petitioners before the learned Single Judge, was to be considered. Accordingly, the petitioner moved an online application. However, the final list has been published, and the name of the petitioner does not appear therein.

Twice, time has been granted to the learned Standing Counsel as well as the learned counsel for respondent nos. 4&5 to obtain instructions in the matter. Today, Mr. Ashok Kumar Singh, learned counsel for respondent nos. 4 and 5 has placed the instructions before the Court, which are taken on record. However, the instructions are not proper, as it mentions only the consideration of the petitioner's case in accordance with the law.

This Court finds that, since the final list has already been published, the instructions are not proper. The other candidates, who were before the learned Single Judge, have been considered, but the claim of the petitioner has been ignored.
