प्रािथनी के िवद्वान अिधवक्ता श्री पवन कुमार िसह तथा राज्य सरकार के िवद्वान अपर शासकीय अिधवक्ता प्रथम श्री योगेश कुमार िसह को सुना।

भारतीय नागिरक सुरक्षा संिहता की धारा 447 के अंतगर्त प्रस्तुत इस प्राथर्ना-पत्र द्वारा प्रािथनी ने प्रधान न्यायाधीश, पािरवािरक न्यायालय, रायबरेली के न्यायालय से वाद संख्या 568/2025 (महजबी खानम बनाम मंसूर रजा खान) अंतगर्त घरेलू िहसा से मिहला संरक्षण अिधिनयम, 2005 की धारा 12 को जनपद सुलतानपुर स्थानांतिरत िकए जाने का अनुरोध िकया है।

स्थानांतरण प्राथर्ना-पत्र में यह अिभकिथत िकया गया है िक प्रािथनी का िववाह िवपक्षी संख्या 2- मंसूर रजा खान के साथ िदनांक 26.10.2000 को हुआ था। इस िववाह से एक पुत्र जो वतर्मान में 22 वषर् का है एवं एक पुत्री जो वतर्मान में 18 की है, उत्पन्न हुए। दोनों बच्चे कलकत्ता में अपने मामा के साथ रहते हैं। िवपक्षी संख्या 2 प्रािथनी का भरण-पोषण नहीं करता है इस कारण से िदनांक 11.03.2025 को भारतीय नागिरक सुरक्षा संिहता की धारा 144 के अंतगर्त वाद संख्या 378/2025 प्रस्तुत िकया है। इसके पूवर् िदनांक 07.02.2025 को प्रािथनी ने ससुरालीजनों के िवरुद्ध प्रथम सूचना िरपोटर् संख्या 60/2025 अंतगर्त धारा 115 (2), 352, 351 (3) भारतीय न्याय संिहता, थाना कोतवाली नगर, जनपद- रायबरेली में अंिकत कराई थी। िदनांक 05.03.2025 को प्रािथनी ने घरेलू िहसा से मिहला संरक्षण अिधिनयम, 2005 की धारा 12 के अंतगर्त िवद्वान न्याियक-िद्वतीय, कक्ष संख्या 19, रायबरेली के समक्ष एक पिरवाद भी प्रस्तुत िकया हुआ है। यािचका के प्रस्तर 10 में कहा गया है िक प्रािथनी वतर्मान में अपने मायके सुलतानपुर में रह रही है।

प्रािथनी ने स्वयं ही िवपक्षी संख्या 2 के िवरुद्ध भारतीय नागिरक सुरक्षा संिहता की धारा 144 तथा घरेलू िहसा से मिहला संरक्षण अिधिनयम, 2005 की धारा 12 के अंतगर्त दो िभन्न कायर्वािहयां रायबरेली िस्थत न्यायालयों में संिस्थत की है तथा उन दोनों में ही प्रािथनी ने अपना पता रायबरेली दशार्या है, उपर उिल्लिखत प्रथम सूचना िरपोटर् भी प्रािथनी ने रायबरेली में ही अपने ससुरालीजनों के िवरुद्ध िलखाई हैं, िकतु उसमें िवपक्षी संख्या 2 को अिभयुक्त के रूप में नािमत नहीं िकया है। उक्त प्रथम सूचना िरपोटर् के कथनों के अनुसार भी प्रािथनी रायबरेली में अपने ससुराल में ही िनवास कर रही है। प्रािथनी कब रायबरेली छोड़कर सुलतानपुर रहने आई इसका कोई कथन न तो यािचका में िकया गया है न ही भारतीय नागिरक सुरक्षा संिहता की धारा 144 तथा घरेलू िहसा से मिहला संरक्षण अिधिनयम, 2005 की धारा 12 के अंतगर्त पिरवाद में िकया गया है। ऐसी पिरिस्थित में प्रािथनी द्वारा स्वयं ही पािरवािरक न्यायालय रायबरेली में संिस्थत कायर्वाही को स्थानांतिरत िकए जाने का कोई समुिचत आधार नहीं है।

तदनुसार, स्थानांतरण प्राथर्ना-पत्र िनरस्त िकया जाता है।
