Heard Sri Siddharth Niranjan, learned counsel for the applicant and learned A.G.A. for the State as well as perused the record.

The present anticipatory bail application has been filed on behalf of the applicant in Case Crime No.623 of 2025, under Section 105, 115(2), 190, 191(2), 191(3) BNS 2023, Police Station- Ramgarhtal, District Gorakhpur, with a prayer to enlarge him on anticipatory bail.

Learned AGA states that he has not received instructions in the matter.

Learned counsel for the applicant claims that the matter is urgent and he may be heard on grant of interim relief. He contends that the applicant was not named in the FIR. Later on in the statement of informant, 11 persons including the applicant have been nominated. He further contends that there is CCTV footage of the incident, which shows the co-accused Pankaj, Vindhyachal and Sahil assaulting the deceased and the applicant is not shown in the said CCTV footage. The applicant has no criminal antecedents.

In view of the submissions made by the Learned counsel for the applicants, a case for grant of interim relief is made out.

List on 24.03.2026 as fresh. In the meantime, Learned AGA may seek instructions.

Till the next date of listing, in the event of arrest of the applicant- Ajit Kumar , involved in the aforesaid case crime, he shall be released on interim anticipatory bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Station House Officer of the police station/Court concerned with the following conditions:-

(i) The applicant shall not tamper with evidence and that he would appear before the trial Court on the date fixed unless exempted by the Court concerned;

(ii) The applicant shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her/them from disclosing such facts to the Court or to any police officer;

(iii) The applicant would co-operate during trial and would not misuse the liberty of bail.

(iv) The applicant shall not leave India without prior permission of the Court concerned.

(v) that the applicant shall not pressurize/intimidate the prosecution witness;

In default of any of the conditions, the prosecution shall be at liberty to file appropriate application for cancellation of interim anticipatory bail granted to the applicant.
