Mohd Jakirul vs State of U.P.

The present anticipatory bail application has been filed on behalf of the applicant in Case Crime No.198 of 2025, under Sections 105, 3(5) of B.N.S., Police Station- Nagra, District- Ballia with a prayer to enlarge him on anticipatory bail.

Learned counsel for the applicant submits that submits that the applicant has been falsely implicated in the present case. He states that although his name has been shown in the First Information Report in the column of the accused, however, in the First Information Report, no allegation of assaulting the deceased or in any other way harming the deceased, has been leveled against the applicant. The applicant is only stated to have sent the deceased to M/s Shreyesh Sotex Industries Pvt. Ltd. which is a rice mill. No offence is made out against the applicant. The applicant is having no criminal antecedents.

The Learned A.G.A., on the other hand, submits that he has not received instructions in the matter.

I have considered the rival submissions made by the learned counsels for the parties.

From the perusal of the First Information Report, it appears that no

allegations have been made against the applicant. The applicant although has been shown as an accused in the column of the accused, however, no criminal act has been assigned to him. The First Information Report was initially lodged at Bihar as a Zero F.I.R. and was then transmitted to the Uttar Pradesh. As no offence appears to have been alleged against the applicant, I deem it appropriate to enlarge the applicant on the interim anticipatory bail till the next date of listing.

Till the next date of listing, in the event of the arrest of the applicant Mohd Jakirul , he shall be released forthwith in the aforesaid case crime on interim anticipatory bail on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Station House Officer of the police station/Court concerned with the following conditions:-

i. the applicant shall make himself available for interrogation by a police officer as and when required;

¶20

ii. that the applicant shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;

iii. that the applicant shall not leave India without the previous permission of the Court;

iv. that the applicant shall not pressurize/intimidate the prosecution witness.
