Heard Sri Gaurav Tripathi Advocate holding brief of Sri Vinay Bhushan Upadhyay, learned counsel for the applicant and learned A.G.A. for the State and perused the record.

The instant application has been preferred by the applicant with a prayer to expedite and conclude the proceedings of Complaint Case No. 543 of 2017 (Siddhartha Maheshwari Vs. Farookh Shaifik) under Section 138 of N.I. Act, Police Station- Kotwali Nagar, District- Saharanpur, pending in the Court of Additional Civil Judge (JD), II (JM), Saharanpur, within stipulated time.

Learned counsel for the applicant submitted that the complaint case no. 543 of 2017 (Siddhartha Maheshwari Vs. Farookh Shaifik) under Section 138 N.I. Act was instituted on 19.05.2017 and till date the proceeding is pending at the stage of recording of evidence of PW- 1 before the learned Trial Court, also the matter is pending since long which is adversely affecting the rights of the applicant.

Learned A.G.A. has no objection if the matter be expedited in the interest of justice.

Keeping in view the period of pendency of the case, it is directed that the learned trial court shall make all endeavour to decide this case expeditiously preferably within a period of six months from the date of
