The instant application has been preferred with a prayer to direct the learned Chief Judicial Magistrate, Azamgarh to decide the application of the applicant dated 20.04.2026 in connection with Criminal Case No. 1731 of 2026 (State of U.P. Vs. Shamsul Huda Khan) arising out of Case Crime No. 240 of 2025 under Sections 420, 120-B I.P.C., Police StationMubarakpur, District Azamgarh, pending in the Court of Chief Judicial Magistrate, Azamgarh, before the specified time so that the applicant may travel to Saudi Arabia for performing his Hajj pilgrimage from the period of 17.05.2026 to 05.06.2026.

Learned counsel for the applicant only sought direction for the learned Chief Judicial Magistrate, Azamgarh to decide the application presented by the applicant dated 20.04.2026 by which he has prayed to seek permission to go to Hajj. Learned counsel for the applicant also submitted that the learned trial court has fixed the dated as 25.06.2026 for hearing of the application which would defeat the very purpose for seeking permission to go to Hajj.

Learned A.G.A.-I has no objection to the submissions made by learned counsel for the applicant.
