आवेदक की ओर से धारा 528 बी.एन.एस.एस /धारा 482 दं०्ऺ०सं० के अन्तगर्त यह आवेदन प्ऴ , आपरािधक पिरवाद. सं० 5294/2021, थाना फेन्ड्स कालोनी, िजला इटावा में िसिवल जज (सी.डी.) एफ.टी.सी./ एिडशनल चीफ जूडीिसयल मिजस ् ेट, इटावा, ्षारा पािरत ्ऺ सं्ञान/तलबी आदेश िदनांक 27.09.2024 एवं आपरािधक पुनरी्षण सं. 270/2024 में एिडशनल सेशन जज/एफ.टी.सी. II, इटावा ारा पािरत आदेश िदनांक 05.01.2026 को अपास्त करने के उ्देश्य से योिजत िकया गया है।

आवेदक के िव्षान अिधव्वा एवं िव्षान अपर शासकीय अिधव्वा को सुना तथा प्ऴावली का पिरशीलन िकया।

आवेदक के िव्षान अिधव्वा का कथन है िक इस ्ऺकरण में प्षकारों के मध्य सुलह समझौता हो जाने की संभावना है. इसिलए इस ्ऺकरण को संबंिधत अवर न्यायालय के सुलह समझौता केन ् को रेफर कर िदया जाय।

िव्षान अपर शासकीय अिधव्वा को उनका यह अनुरोध स्वीकार िकए जाने में कोई आपि्त नहीं है।

मामले के तथ्यों एवं पिरिस्थितयों के दृि्िगत इस ्ऺकरण में यह िनदरॏिशत िकया जाता है िक दोनों प्षकार संबंिधत अवर न्यायालय के सम्ष उपिस्थत होकर मामले को सुलह सम्झौता के ्षारा िनस्तािरत करने के िलए आवेदन प्ऴ ्ऺस्तुत करें। यिद ्ऺकरण को सुलह समझौता के आधार पर िनस्तािरत करने के संबंध में आवेदन प्ऴ अबर न्यायालय के सम्ष ्ऺस्तुत िकया जाता है ती संबंिधत न्यायालय ्षारा आवेदन प्ऴ ्ऺस्तुत िकए जाने की ितिथ से एक सप्ताह के अन्दर उस पर उिचत आदेश पािरत िकया जाय तथा संबंिधत मीिडऐशन सेन्टर ्षारा उसे 4 माह के अन्दर िनस्तािरत कर िदया जाय।

आज से 6 माह तक आवेदक के िवरू्ध उपरो्व वाद में समस्त अि्षम कायर्वाही स्थिगत रहेगी।

यहाँ पर यह स्प्ि िकया जाता है िक यिद प्षकारों के मध्य उ्व मीिडऐशन की ्ऺि्वया िवफल होती है तो संबंिधत अवर न्यायालय उपरो्व वाद में आवेदक के िवरु्ध िनयमानुसार िविधक कायर्वाही करने को स्वतं्ऴ है और यिद प्षकारों के मध्य उ्व मीिडऐशन की ्ऺिकया सफल होती है तो आवेदक मीिडऐशन सेन्टर की उस आख्या के साथ इस न्यायालय में आने को स्वतं्ऴ है।
