आवेदकगण की ओर से अंतगर्त धारा 528 बी.एन.एस.एस. के अंतगर्त यह आवेदन प्ऴ, मु०अ०सं० 559/2019 से उ्यूत स्ऴ परी्षण सं० 1198 वषर् 2024, अंतगर्त धारा 498ए, 323, 504, 307 भा.दं.सं. एवं 3/4 दहेज ्ऺितषेध अिधिनयम, थाना एत्मा्दौला, िजला आगरा, मे िव्षान अपर िजला एवं स्ऴ न्यायाधीश, क्ष सं० 23, आगरा ्षारा पािरत आरोप ं िवरचन आदेश िदनांिकत 04.10.2024 तथा आदेश िदनांिकत 21.09.2024 के िवरु्ध योिजत िकया गया है।

आवेदकगण के िव्षान अिधव्वा, िवप्षी के िव्षान अिधव्वा एवं िव्षान अपर शासकीय अिधव्वा को सुना तथा प्ऴावली का पिरशीलन िकया।

आवेदकगण के िव्षान अिधव्वा ने कथन िकया है िक आवेदक के ्ऺश्नगत आरोिपत धाराओं का अपराध नहीं बनता है तथा उपर्यु्व मामलें में िवचारण न्यायालय ्षारा इस मामलें में आवेदकगण के िवरु्ध आदेश पािरत करते समय तथ्यों का सम्यक पिरशीलन नहीं िकया गया तथा ्ऺश्नगत आदेश एक 'स्पीिकग' (सकारण) एवं तकर्संगत आदेश नहीं है तथा उ्व ्ऺश्नगत आदेश मा्ऴ अनुमानों और कयासों के आधार पर पािरत िकया गया है। अतः उपरो्व ्ऺश्नगत आदेश समुिचत िववेचना एवं तथ्यों पर आधािरत नहीं है। इसिलए, ्ऺश्नगत आदेश ्ऴुिटपूणर् है एवं अपास्त िकए जाने योग्य है।

िवप्षी सं० 2 के िव्षान अिधव्वा एवं िव्षान अपर शासकीय अिधव्वा ने कथन िकया िक उ्व वाद के संबंध में आवेदकगण की तरफ से एक अन्य ्ऺाथर्नाप्ऴ अंतगर्त धारा 482 दं०्ऺ०सं० सं० 62 वषर् 2022 दािखल िकया गया है, उ्व ्ऺाथर्नाप्ऴ में उभयप्ष में मध्यस्थता हेतु मध्यस्थता केन ् , उच्च न्यायालय, इलाहाबाद को संदिभत िकया गया था, िकन्तु दोनों प्षों में मध्यस्थता स्थािपत नहीं हो सकी है। ्ऺश्नगत मामलें में समुिचत िववेचना के

उपरांत िवचारण न्यायालय ्षारा पयार्प्त आधार पर ्ऺश्नगत आदेश पािरत िकये गये हैं, िजसमें कोई िविधक अथवा ्षे्ऴ ािधकार संबंधी ्ऴुिट पिरलि्षत नहीं हो रही है। आवेदक के िव्षान अिधव्वा ्षारा ्ऺश्नगत आदेश को अपास्त करने हेतु जो तकर् ्ऺस्तुत िकए गए वे बलहीन है। इसिलए, ्ऺश्नगत आदेश में हस्त्षेप िकए जाने की कोई आवश्यकता ्ऺतीत नहीं हो रही है।

उभय प्ष के िव्षान अिधव्वागण के तकॏल को ्शवणोपरांत एवं प्ऴावली व ्ऺश्नगत आदेशों का सम्यक रूपेण पिरशीलन िकया। उपरो्व विणत अिभयोग में न्यायालय ्षारा इस मामलें को मध्यस्थता कें्श (Mediation Center) भी भेजा गया था, िकन्तु दोनों प्षों में मध्यस्थता स्थािपत नहीं हो सकी है तथा आवेदकगण के ्षारा संबंिधत िवचारण न्यायालय में दािखल उन्मोचन ्ऺाथर्नाप्ऴ में पािरत आदेश िदनांिकत 04.10.2024 में कोई िविधक ्ऴुिट पिरलि्षत नहीं हो रही है, साथ ही धारा 482 सी.आर.पी.सी के तहत अपनी शि्व का ्ऺयोग करते हुए इस न्यायालय को आरोपों की सत्यता और साष्यों की िव्षसनीयता का आकलन करने की आवश्यकता नहीं है। अतः िव्षान िवचारण न्यायालय के आदेश और पिरणामी कायर्वाही को र्द करने की ्ऺाथर्ना अस्वीकृत की जाती है। उ्व को ध्यान में रखते हुए, यह आवेदन प्ऴ स्वीकार िकये जाने योग्य नहीं है।

तद्नुसार, आवेदकगण की ओर से धारा 528 बी.एन.एस.एस. के अंतगर्त ्ऺस्तुत यह आवेदन प्ऴ िनरस्त िकया जाता है।

्ऺश्नगत ्ऺकरण में यिद कोई अन्तिरम आदेश हो तो उसे समाप्त समझा जाय।

कायार्लय को िनदरॏश िदया जाता है िक इस आदेश की एक ्ऺितिलिप संबंिधत अवर न्यायालय को अिवलम्ब भेजना सुिनि्ात िकया जाय।
