Learned counsel for the petitioner submits that the corpus, Tanu Chauhan, is the legally wedded wife of Ishwarpal and is presently in the custody of private respondent No. 5. He further submits that the corpus is a major whose High School certificate has been annexed to the petition.

It is further submitted that the corpus, being dissatisfied with her parental home, left her family and initially proceeded to District Saharanpur, where she was detained in a Nari Niketan. Thereafter, her custody was handed over to her maternal aunt, namely Urmila, who has been arrayed as respondent No. 4.

Learned counsel further contends that there exists no legal justification for the respondents to retain the custody of the corpus, who, being a major and the legally wedded wife of petitioner No. 2, Ishwarpal, is entitled to reside in accordance with her own free will.

In view of the aforesaid, learned AGA is directed to furnish a report and to ensure the production of the corpus before this Court on 05.05.2026 positively.
