यािचकाकतार् के िवद्वान अिधवक्ता श्री अस्करी हुसैन तथा िवद्वान अपर शासकीय अिधवक्ता प्रथम श्री गणेश दत्त भट्ट को सुना तथा पत्रावली का अवलोकन िकया।

भारतीय यह यािचका 28 वषीर्या िनरुद्ध मिहला अंशु गौतम की तरफ से उसके िपता बाबू लाल गौतम के माध्यम से यह कहते हुए प्रस्तुत की गयी है िक अंशु गौतम िवपक्षी संख्या 4, 5 की अवैध अिभरक्षा में है।

यािचका में कहा गया है िक अंशु गौतम कहीं गायब हो गयी हैं तथा उसके िपता बाबू लाल गौतम को एक मिहला का फोन आया िजसने सूिचत िकया िक अंशु गौतम को िवपक्षी संख्या 4 तथा 5 ने अवैध अिभरक्षा में रखा है। इस संबंध में यािचकाकतार् ने पुिलस को िलिखत िशकायत दी िकन्तु पुिलस ने कोई कायर्वाही नहीं की।

िलिखत अनुदेशों के आधार पर िवद्वान अपर शासकीय अिधवक्ता प्रथम ने यािचका का िवरोध करते हुए कहा िक यािचका में कहे गये मोबाइल नंबर पर पुिलस ने कॉल िकया। यह कॉल िवपक्षी संख्या 5 राम जानकी गौतम ने िरसीव िकया तथा वह अपने पित बाबू लाल गौतम के साथ पुिलस के समक्ष उपिस्थत आयीं एवं बताया वह लोग अंशु गौतम के िपता बाबू लाल गौतम की िरश्तेदार हैं। उन्होंने अपनी बड़ी बेटी चांदनी गौतम की शादी यािचकाकतार् बाबू लाल गौतम के बड़े पुत्र अशोक गौतम के साथ की है।

उपरोक्त तथ्य का यािचका में उल्लेख नहीं िकया गया है।

गुमशुदगी दजर् कराने अथवा अिभयोग दजर् कराने हेतु प्राथर्ना-पत्र उपलब्ध कराने हेतु कहा गया िकन्तु बाबू लाल गौतम ने कोई प्राथर्ना-पत्र उपलब्ध नहीं कराया तथा कहा िक वह अपने अिधवक्ता के माध्यम से मामले का िनस्तारण कराएंगे। िलिखत अनुदेशों में यह भी कहा गया है िक थाने पर कोई भी अिभयोग या गुमशुदगी पंजीकृत नहीं है, प्राथर्ना-पत्र प्राप्त होने पर प्रकरण में आवश्यक िविधक कायर्वाही की जायेगी।

ऐसी पिरिस्थित में जबिक यािचका में संपूणर् तथ्यों का सही प्रकार से उल्लेख नहीं िकया गया है तथा यह तथ्य िछपाया गया है िक यािचकाकतार् बाबू लाल गौतम की पुत्रवधू हैं, यािचका में कहे गये कथनों के अनुसार अंशु गौतम की आयु 28 वषर् है तथा पुिलस के द्वारा िदये गये अनुदेशों के अनुसार अजय गौतम की आयु 20 वषर् है तथा उपरोक्त दोनों व्यिक्त स्वेच्छा से कहीं चले गये हैं, प्रकरण अवैध अिभरक्षा का प्रतीत नहीं होता है।

तद्नुसार, यािचका बलहीन है एवं िनरस्त की जाती है।
