Heard Sri Sudhakar Mishra, learned counsel for the petitioner and learned A.G.A for the State.

Learned counsel for the petitioner submits that the impugned FIR has been lodged on the basis of wrong and concocted story. He further submits that the petitioner is a bonafide purchaser of the land in dispute. After purchasing the land from the recorded tenure holder, the petitioner sold it to the other person. However, the FIR has been lodged alleging therein that the seller, who was the predecessor-in-interest of the petitioner had died on 24.12.2013 whereas the sale-deed was executed in favour of the petitioner on 08.05.2019, therefore, the question of execution of sale-deed by her after the death does not arise.

It also transpires from the FIR that the predecessor- in- interest of the petitioner was killed on account of which Case Crime No. 696 of 2013 registered at Police Station Gomti Nagar, Lucknow was lodged in which the charge-sheet has also been filed.

4.Learned counsel for the petitioner also submits that the petitioner himself has been cheated and is a victim, if the version of F.I.R is found to be correct and in that case, the petitioner is ready to return the property.

Learned A.G.A submits that the impugned F.I.R has been lodged through Section 156 (3) Cr.P.C and in the said proceedings notices must

have been issued to the petitioner and a report should have been submitted by the police, therefore he prays that sometime may be granted to seek instructions in the matter.
