2. Heard Shri Onkar Nath Nishad, learned Counsel for the petitioner, learned A.G.A. for the State and Shri Ashutosh Mishra, learned Counsel for the opposite party no.4.

3. This petition seeks issuance of direction in the nature of certiorari for quashing the impugned F.I.R. bearing FIR No.0021 of 2026, under Sections 69, 115(2), 351(3), 352 of B.N.S., 2023, Police Station Fakharpur, District Bahraich.

Learned counsel for the petitioner, after arguing at some length, submits that he does not want to press this petition, therefore, the same may be dismissed as not pressed with liberty to avail appropriate remedy under the Bharatiya Nagarik Suraksha Sanhita, 2023. To which, there is no objection by learned A.G.A. and learned Counsel for the opposite party no.4.

5. In view of above, the present writ petition is dismissed as not pressed with liberty as aforesaid.
