This writ petition has been filed seeking to quash FIR dated 21.04.2026, giving rise to Case Crime No.92 of 2026, under Sections 115(2), 352, 351(3), 333, 76 of the B.N.S., Police Station Sarai Inayat, District Prayagraj.

Heard Mr. Vinod Kumar Pal, learned counsel for the petitioners, Mr. Ajeet Bhaskar, learned counsel for respondent no. 3 and Mr. Shashi Shekhar Tiwari, learned Additional Government Advocate for respondent nos. 1 and 2.

A perusal of the impugned F.I.R. shows that the petitioners entered the informant's house on 15.04.2026 at about 9:15 p.m. armed with sticks (lathidan da) and iron rods ( sariya) and abused the informant's son in vulgar language, dragged him and beat him up. In order to save the informant's son, his daughter and wife rushed to his rescue. This led the petitioners to thrash the informant's daughter, Pooja, who has received serious injuries, as alleged in the F.I.R. Her clothes were also torn.

Learned AGA has produced the medico-legal report relating to the informant's daughter, Pooja, which shows the following injuries sustained:

Lacerated wound 1cm x 0.5 cm on left side upper part of nose, margin irregular, blood clot present.

Contusion 3cm x 2cm on right upper hypochondrium, Redish.

Abrasion 4cm x 0.4 cm on lateral aspect of right arm, 10 cm below from tip of right shoulder, Redish.

Contusion 4cm x 1cm on right chest, 7.5cm below from right clavicle,

The injuries are apparently serious and indicate that the assertions in the F.I.R. are prima facie credible. The matter requires thorough investigation. It is not a case where we can determine the truth of the allegations, which constitute the petitioner's disputed defence. These have to be thrashed out during investigation and, if the petitioners are chargesheeted, determined at the trial. We do not find any good ground to interfere with the impugned F.I.R.
