Heard Mr. Vinod Shankar Tripathi, learned Counsel for the petitioners and Mr. Shashi Shekhar Tiwari, learned Additional Government Advocate for the State.

This writ petition has been filed seeking to quash FIR dated dated 12.02.2026, giving rise to Case Crime No.52 of 2026, under Section 106(1) of B.N.S., Police Station Phoolpur, District Praygaraj.

The informant's daughter, who was in the family way, was taken into a sham hospital maintained by the petitioners, who are prima facie quacks. It is brought to our notice that the Chief Medical Officer has stated during investigation that neither the hospital, which is run by the petitioners, is registered nor the petitioners hold any medical degree to practice medicine. During treatment, the informant's daughter died. The petitioners were endvouring to do away with her body and destroying evidence when they were apprehended by the villagers. Thereafter, the present F.I.R. has been lodged.

In our considered opinion, this is not a case where any kind of protection that is available to authorized medical practitioners can be extended. The petitioners appear to be quacks. It is a case which requires to be thoroughly investigated. There is no good ground to quash the impugned F.I.R.
