Post passing of the order dated 28.04.2026, the matters is before this Court.

The present contempt application has been preferred alleging noncompliance of the order dated 02.08.2024 passed in Writ A No. 2846 of 1992 wherein this Court held that the appointment of the with petitionerapplicant has an Assistant Teacher is an approved one and the respondents therein and the opposite party herein were commanded to make payment of arrears of salary within a period of two months.

Post issuance of the notice, affidavits have been exchanged.

An affidavit came to be filed by one Ram Teerath Pandey @ Ram Tirath wherein para-28, it was asserted that the total amount due and payable is Rs. 68,22,771/-, thereafter the matter was taken up on several occasions and lastly on 20.04.2026, the following orders were passed:

"Compliance filed today is taken on record.

Learned counsel for the applicant has filed objection to the compliance affidavit, which is taken on record.

Let the Manager of the Shankarji Purva Madhyamik Sanskrit Vidyalaya, Kandriyavana, District-Ambedkar Nagar/opposite party No.2 and the District Inspector of Schools, Ambedkar Nagar/opposite party No.5 appear before this court on the next date fixed in the matter for taking appropriate action against these persons including framing of charges.

Today an affidavit of compliance has been filed, sworn by one Shri Praveen Kumar Tiwari claiming himself to be District Inspector of Schools, Ambedkar Nagar wherein in para-11 it has been asserted that an amount of Rs. 4453016/- has been released after deduction of applicable tax and after adjusting the previous amount paid Rs. 18,74,915/-.

In the opinion of the Court, the contempt proceedings cannot be used as a tool to adjudicate any issue on merits as what the Contempt of Courts are required to do is to ensure compliance of the orders passed on the writ side.

Apparently, the stand of the opposite parties is that the entire amount has been paid post deduction of the statutory amount which is to be deducted as per the income tax laws.

Be that as it may be since there happens to be a substantial compliance and once the petitioner-applicant is disputed the quantum then the remedy lies elsewhere.

Accordingly, the contempt application stands consigned to record.

Leaving it open for the petitioner-applicant to question the said action in an appropriate forum.

The presence of Shri Praveen Kumar Tiwari, District Inspector of Schools, Ambedkar Nagar who has been identified by Shri Anirudh Singh, learned Standing Counsel, his appearance is no more required.
