The counsel for the rival parties have made a joint statement that they do not propose to file any further affidavits thus with the consent of the parties, writ petition is being decided at the admission stage.

The case of the writ petitioner is that he was engaged as a gardener in Rajkiya Paudhshala, Walipur Tata, Manjhanpur, District Kaushambi, under District Horticulture Officer, District Kaushambi on daily wage basis on 1.1.2008. The writ petitioner performed duties 26 days in a month except Sunday. However, after the period of approximately 4 years on 01.12.2011 without giving any notice, the fourth respondent, Incharge, Rajkiya Paudhshala, Walipur Tata, Manjhanpur, District Kaushambi dislodge the writ petitioner from his engagement in violation of Articles 14, 16, 21 of the Constitution of India. The writ petitioner got the matter referred before the labour court and thereafter the Presiding Officer, Labour Court, Uttar Pradesh, Prayagraj in Adjudication Case No. 53 of 2012 proceeded to pass an award which on 25.03.2021 which reads as under:

औद्योिगक िववाद का िववरण

" क्या सेवायोजकों द्वारा संबंिधत श्रिमक श्री बच्चा लाल पुत्र श्री राम आसरे की सेवायें िदनांक 01-12-2011 से समाप्त िकया जाना उिचत तथा/अथवा वैधािनक है? यिद नहीं तो संबिन्धत श्रिमक क्या िहतलाभ/अनुतोष (िरलीफ) पाने का अिधकारी है? एवं अन्य िकस िववरण सिहत? िववाद का संज्ञान लेकर पक्षा को सम्मन / नोिटस भेजी गई। पक्षकार न्यायालय में उपिस्थित आए तथा अपने-अपने अिधकार पत्र, िलिखत कथन, प्रितउत्तर अिभलेखीय एथ मौिखक साक्ष्य प्रस्तुत िकये।

श्रिमक पक्ष नोटराइज्ड शपथ पत्र िदनाँक 24-09-2012 द्वारा कथन है िक वह राजकीय पौधशाला वलीपुर, टाटा, कौशाम्बी में माली के पद पर िदनांक 01-01-2008 को िनयोिजत हुआ था तथा िनयोजन की ितिथ से िदनांक 30-11-2011 िनरन्तर काय र ्त रहा। िदनांक 0112-2011 को उ०प्र० औद्योिगक िववाद अिधिनयम 1947 को प्रािवधानों का पालन िकए िबना उसे सेवा से पृथक कर िदया गया। प्रितष्ठान में उसका कायर् नस र ्ी तैयार करने हेतु पानी लगाना, िनराई, गुडाई, छटाई आिद करना था। प्रितष्ठान में आवश्यकतानुसार वादी श्रिमक व अन्य दैिनक वेतन भोगी मजदूर िनयोिजत िकए जाते रहे हैं, िजनकी उपिस्थित मस्टर रोल पर होती थी और उनको वेतन का भुगतान मस्टर रोल पर ही होता था। वादी को कभी भी वेतन समय से नहीं िमलता था। वादी का वेतन माह फरवरी, 2011 से अगस्त, 2011 तक का बकाया हो गया था, िजसके कारण वादी वेतन भुगतान अिधिनयम 1936 के अन्तगर्त अपने बकाया वेतन हेतु सक्षम प्रािधकारी के समक्ष तारा प्रस्तुत िकया था। उक्त बाद में वादी ने शासन द्वारा िनधार्िरत न्यूनतम वेतन के आधार पर प्रितवादी से वेतन की मांग की थी, िजससे नाराज होकर िदनांक 01-12-2012 से उसको सेवाएं समाप्त कर दी। बाध्य होकर उसने औद्योिगक िववाद अिधिनयम 1947 की धारा 2 (ए) के अन्तगर्त वाद उठाया, जो अिभिनणर्य हेतु मा० न्यायालय को समक्ष प्रेिषत िकया गया। उसकी सेवा समािप्त से पूवर् औद्योिगक िववाद अिधिनयम की धारा 6-एन का पालन नहीं िकया गया और सेवा समािप्त की ितिथ से वह बेरोजगार है। वादी ने प्राथर्ना की है िक उसे सेवा समािप्त की ितिथ से सेवा में बहाल िकये जाने की ितिथ तक का पूणर् वेतन व िनरन्तरता सिहत बहाल िकये जाने का आदेश िदया जाए।

सेवायोजक की ओर से िदनाँक 24-09-2012 को सशपथ श्री रणिवजय िसह, िजला उद्यान अिधकारी कौशाम्बी का कथन है िक वादी श्रिमक कायर् की आवश्यकतानुसार राजकीय पौधशाला, बलीपुर टाटा कौशाम्बी में िनराई गुडाई का कायर् िकये, िकन्तु वादी को बतौर स्थाई श्रिमक के रूप में कभी िनयोिजत नहीं िकया गया। वादी राजकीय पौधशाला, बलीपुर टाटा कौशाम्बी में वषर् 2008 से जून, 2011 तक दैिनक मजदूरी के आधार पर नस र ्ी में कायर् िकया। जून, 2011 के बाद बादी उक्त नस र ्ी में कायर् करने नहीं आये तथा िमथ्या कथन के आधार पर मुकदमेबाजी करने लगे और िवभागीय अिधकािरयों पर दबाव बनाकर अपनी िनयुिक्त कराना चाहते हैं। राजकीय पौधशाला में िनयिमत कायर् के िलये थे कमर्चारी िनयुक्त है। वादी श्रिमक उक्त नस र ्ी में मािसक िनयोिजत मजदूर नहीं रहे है और न ही उन्हें मािसक पािरश्रिमक के आधार पर कभी िनयोिजत िकया गया और इसिलए वादी की सेवा समािप्त करने का कोई औिचत्य है। सेवायोजक का यह भी कथन है िक राजकीय पौधशाला, बलीपुर टाटा, कौशाम्बी, उ०प्र० सरकार के अधीन िवभाग है, जो लोकिहत में पौध तैयार करके िबना िकसी लाभ के

सामािजक वािनकी के कायर् को प्रोत्सािहत करती है। उक्त पौधशाला में कम्पनी एक्ट की व्यवस्था प्रभावी नहीं है। प्रितष्ठान में कमर्चािरयों की िनयुिक्त उ०प्र० सरकार द्वारा बनाई गई िनयमावली के अन्तगर्त होती है और उनका िनयंत्रण उ०प्र० सरकार कमर्चारी िनयुिक्त एवं दण्ड िनयमावली 1999 के अधीन होता

पक्षों ने अपने अपने प्रितउत्तर में एक दूसरे के कथन का प्रितवाद करते हुये स्वयं के कथनों पर बल देते हुए अपने-अपने कथनों की पुनरावृित्त की है। प्रितउत्तर में िनयोजक पक्ष ने तत्कालीन िजला उद्यान अिधकारी अखण्ड प्रताप िसह ने 10-10-2012 के प्रस्तर 09 एवं 10 में कहा िक पौधशाला का रखरखाव उ०प्र० सरकार के उद्यान िवभाग द्वारा िकया जाता है तथा उसमें िनयुक्त कमर्चारी उ०प्र०सरकार द्वारा बनायी गयी िनयमावली के अन्तगर्त िनयुक्त होते है और उक्त पर कारखाना अिधिनयम लागू नहीं होता है। वादी न तो उ०प्र० औद्योिगक िववाद अिधिनयम 1947 की धारा 2(ए) के अन्तगर्त वकर्मैन है और न ही उद्यान िवभाग कारखाना है इसिलये वादी िकसी अनुतोष का मुश्तहक नहीं है और वाद उपरोक्त सव् य िनरस्त होने योग्य है।

श्रिमक पक्ष की ओर से सूची 14-बी/2 के माध्यम से 09 अिभलेखों की छाया-प्रितयाँ प्रस्तुत की गई, िजन्हें सेवायोजक प्रितिनिध द्वारा स्वीकार िकए जाने पर प्रदशर् डब्लू०-1 से प्रदशर् डब्लू०-7 के रूप में प्रदिशत िकया गया। सेवायोजक पक्ष की ओर से सूची 11 बी/1 के माध्यम से 39 अिभलेखों की छायाप्रितयाँ प्रस्तुत की गई, िजन्हें श्रिमक प्रितिनिध द्वारा स्वीकार िकए जाने पर प्रदशर् ई0-1 से प्रदशर् ई0-30 के रूप में प्रदिशत िकया गया। श्रिमक पक्ष की ओर से वादी श्रिमक श्री बच्चा लाल डब्लू० डब्लू०-1 का साक्ष्य 21-सी, श्री सुरेन्द्र कुमार डब्लूडब्लू०2 का साक्ष्य 25-सी पर दजर् िकया गया तथा सेवायोजक प्रितिनिध द्वारा िजरह की गई। सेवायोजक पक्ष की ओर श्री बृजभान ई०डब्लू०-1 का साक्ष्य 26-सी व श्री पंकज कुमार शुक्ल, िजला उद्यान अिधकारी का साक्ष्य ई० डब्लू०-2 के रूप में 34-सी पर दजर् िकया गया, िजनसे श्रिमक प्रितिनिध द्वारा िजरह की गई।

वाद से संबंिधत श्रिमक मच्चा लाल डब्लू० डब्लू०-1 का सशपथ मौिखक साक्ष्य है िक वह राजकीय पौधशाला बलीपुर टाटा कौशाम्बी में जनवरी, 2008 से माली के पद का दैिनक वेतन भोगी के रूप में कायर् करता था। उसे िदनांक 01-12-2011 से कायर् से पृथक कर िदया गया। कायर् से पृथक करने से पूवर् उसे न तो एक माह का नोिटस िदया गया और न ही नोिटस के बदले वेतन िदया गया। िजरह िकए जाने पर उसने स्वीकार िकया है िक उसकी हािजरी मस्टर रोल पर होती थी तथा भुगतान भी मस्टर रोल पर ही प्राप्त कराया जाता था। उसने यह भी स्वीकार िकया है िक उसे माचर्, 2011 तक की मजदूरी उसे प्राप्त हो गई है तथा वेतन भुगतान अिधिनयम के अन्तगर्त वाद लगाने के पश्चात् माह अप्रैल, 2011 से जून, 2011 तक की मजदूरी प्राप्त करने हेतु िनयोजकों द्वारा पत्र भेजा गया था, िकन्तु न्यूनतम् वेतन से कम मजदूरी होने के कारण वह लेने नहीं गया था। श्रिभक्त के दूसरे गवाह ने अपने बयान में बताया िक वह राजकीय पौधशाला बिलपुर टाटा, कौशाम्बी में माली के पद पर कायर् करता है। यह भी वषर् 2008 से माली का कायर् कर रहा है। उसने अपने बयान में यह स्वीकार िकया है िक जब वह वषर् 2008 में माली का कायर् करने हेतु आया, तो वादी बच्चा लाल माली का कायर् कर रहे थे। वादी श्रिमक बच्चा लाल को सेवा से िनकाले जाने के बाद कायर् पर नहीं िलया गया। िजरह में जसने यह स्वीकार िकया है िक बच्चा लाल स्थाई कमर्चारी नहीं थे, बिल्क आवश्यकता पड़ने पर वादी को बुलाया जाता था।

सेवायोजक की ओर से श्री बृज लाल, माली ई०डब्लू०-1 का साक्ष्य है िक यह राजकीय पौधशाला कौशाम्बी में माली के पद पर काय र ्त है। पौधशाला में कायर् अिधक हो जाने पर अितिरक्त श्रिमक दैिनक वेतन भोगी के रूप में रखे जाते हैं। वादी श्रिमक के रूप में वषर्, 2008 से वषर्, 2011 तक कायर् िकए हैं, िकन्तु लगातार कायर् नहीं िकया, बिल्क आवश्यकता पड़ने पर श्रिगक की अनुमित िवभाग द्वारा प्राप्त होने पर उन्हें कायर् के िलए बुलाया जाता था। वादी को न्यूनतम् वेतन रु० 100/- प्रितिदन मजदूरी िदया जाता था। वादी की हािजरी मस्टर रोल पर होती थी। िजरह में उसने स्वीकार िकया है िक वादी ने न्यूनतम् वेतन अिधिनयम के अन्तगर्त उप श्रमायुक्त के यहाँ वाद लगाया था। कहा िक यह कहना गलत है िक वादी को उपरोक्त कारणों से नौकरी से हटा िदया गया था। सेवायोजक के दूसरे गवाह श्री पंकज कुमार शुक्ल ई०डब्लू०-2 िजला उद्यान अिधकारी का साक्ष्य है िक प्रितष्टान में 03 माली के पद सृिजत है। समूह "घ" का पद, िजसमें माली, चपरासी आते हैं, की िनयुिक्त उ०प्र० शासन के समूह "घ" की िनयमावली के अन्तगर्त होती है। वादी श्रिमक वषर्, 2008 से वषर् 2011 तक आवश्यकतानुसार कायर् पर मस्टर रोल पर लगाया जाता था। िजरह में उन्होंने स्वीकार िकया है िक प्रितष्ठान में 03 पद माली का सृिजत है। समूह "घ" िनयमावली 1991 के अन्तगर्त िविनयिमितकरण िकया गया है। वादी श्रिमक का िविनयिमितकरण में नाम नहीं था। वादी की उपिस्थित मस्टर रोल पर अंिकत होती है। बादी को मजदूरी का भुगतान नस र ्ी मद से िकया जाता है। मनरेगा हेतु जो

बजट िमलता है, वह िजलािधकारी द्वारा अनुमोिदत होता है।

उभय पक्षों के िवद्वान अिधकृत प्रितिनिधयों द्वारा प्रस्तुत तकर्/बहस तथा पत्रावली पर उपलब्ध अिभलेखों का सूक्ष्मतः से गंभीरतापूवर्क अवलोकन िकया गया।

श्रिमक पक्ष का तकर् है िक वह राजकीय पौधशाला वलीपुर, टाटा, कौशाम्बी में माली के पद पर िदनांक 01-01-2008 को िनयोिजत हुआ था तथा िनयोजन की ितिथ से िदनांक 30-112011 िनरन्तर काय र ्त रहा। िदनांक 01-12-2011 को उ०प्र० औद्योिगक िववाद अिधिनयम 1947 के प्रािवधानों का पालन िकए िबना उसे सेवा से पृथक कर िदया गया। प्रितष्ठान में उसका कायर् नस र ्ी, तैयार करने हेतु पानी लगाना, िनराई, गुड़ाई, छटाई आिद करना था। प्रितष्ठान में आवश्यकतानुसार वादी श्रिमक व अन्य दैिनक वेतन भोगी मजदूरो के साथ िनयोिजत िकए जाते रहे हैं िजनकी उपिस्थित मस्टर रोल पर होती थी और उनको वेतन का भुगतान मस्टर रोल पर ही होता था। वादी को कभी भी वेतन समय से नहीं िमलता था। वादी का वेतन माह फरवरी, 2011 से अगस्त, 2011 तक का बकाया हो गया था, िजसके कारण वादी वेतन भुगतान अिधिनयम 1936 के अन्तगर्त अपने बकाया वेतन हेतु सक्षम प्रािधकारी के समक्ष वाद प्रस्तुत िकया था। उक्त वाद में वादी ने शासन द्वारा िनधार्िरत न्यूनतम वेतन के आधार पर प्रितवादी से मांग की थी. िजससे नाराज होकर िदनांक 01-12-2012 से उसकी सेवाएं समाप्त कर दी। बाध्य होकर उसने औद्योिगक िववाद अिधिनयम 1947 की धारा 2 (ए) के अन्तगर्त वाद उठाया, जो अिभिनणर्य हेतु मा० न्यायालय के समक्ष प्रेिषत िकया गया। उसने प्रत्येक कैलेण्डर वषर् में 240 िदन से अिधक कायर् िकया है, िजसका प्रमाण प्रदशर् डब्लू०-1 लगायत्त 4 से है। उसे सेवा समािप्त से पूवर् औद्योिगक िववाद अिधिनयम की धारा 6-एन का पालन नहीं िकया गया और सेवा समािप्त की ितिथ से वह बेरोजगार है। वादी ने प्राथर्ना की है िक उसे सेवा समािप्त की ितिथ से सेवा में बहाल िकये जाने की ितिथ तक का बेकारी अविध का पूणर् वेतन व िनरन्तरता सिहत सेवा में बहाल िकये जाने का आदेश िदया जाए।

सेवायोजक का तकर् है िक वादी श्रिमक कायर् की आवश्यकतानुसार राजकीय पौधशाला, बलीपुर टाटा, कौशाम्बी में िनराई गुडाई का कायर् िकये। वादी राजकीय पौधशाला, बलीपुर टाटा, कौशाम्बी में वषर्, 2008 से जून, 2011 तक दैिनक मजदूरी के आधार पर नस र ्ी में कायर् िकया। जून, 2011 के बाद वादी उक्त नस र ्ी में कायर् करने नहीं आये तथा िमथ्या कथन के आधार पर मुकदमेबाजी करने लगे और िवभागीय अिधकािरयों पर दबाव बनाकर अपनी िनयुिक्त कराना चाहते है। राजकीय पौधशाला में िनयिमत कायर् के िलये कमर्चारी िनयुक्त है। वादी श्रिमक उक्त नस र ्ी में मािसक िनयोिजत मजदूर नहीं रहे है और न ही उन्हें मािसक पािरश्रिमक के आधार पर कभी िनयोिजत िकया गया और न वादी की सेवा समाप्त करने का कोई औिचत्य है। सेवायोजक का यह भी कथन है िक राजकीय पौधशाला, बलीपुर टाटा, कौशाम्बी, उ०प्र० सरकार के अधीन िवभाग है, जो लोकिहत में पौध तैयार करके िबना िकसी लाभ. सामािजक वािनकी के कायर् को प्रोत्सािहत करती है। उक्त पौधशाला में कम्पनी एक्ट की व्यवस्था प्रभावी नहीं है। प्रितष्ठान में कमर्चािरयों की िनयुिक्त उ०प्र० सरकार द्वारा बनाई गई िनयमावली के अन्तगर्त होती है और उनका िनयंत्रण उ०प्र० सरकार कमर्चारी िनयुिक्त एंव दण्ड िनयमावली, 1999 के अधीन होता है। सवायोजक के अिधकृत प्रितिनिध ने अपने तकर् को आगे बढाते हुये कहा िक वषर् 1999 में जनपद कौशाम्बी सृिजत हुआ था तथा प्रितष्ठान में पद भी सृिजत िकये गये थे।

वस्तुतः सेवायोजक द्वारा दािखल मनरेगा से संबंिधत पत्रजात प्रदशर् ई-22 से ई26 तक में वादी मजदूर का नाम अंिकत है, िजससे यह भी स्पष्ट होता है िक वादी ने स्वयं व अपने पिरवार के गरीबी रेखा से नीचे का होने के कारण जाब काडर् के आधार पर जीिवकोपाजर्न हेतु िदनाँक 1908-2010 से 31-12-2010 तक महात्मा गाँधी राष्ट्रीय ग्रामीण रोजगार गारण्टी योजना, के अन्तगर्त िवकास खण्ड चायल, जनपद-कौशाम्बी के अन्तगर्त राजकीय पौधशाला बलीपुरटाटा कौशाम्बी में कायर् िकया है। दैिनक वेतन भोगी श्रिमको को मजदूर के रूप में योजनान्तगर्त रखा गया था। सेवायोजक द्वारा यह स्पष्ट नहीं िकया जा सका िक एक वषर् में 240 िदन से अिधक कौन-कौन से श्रिमक कायर् िकये और न ही उन श्रिमकों की सूची दािखल की है, िजसमें िविनयिमितकरण के समय उस पर िवचार िकया गया हो। यह भी स्पष्ट नहीं कर सकें िक िजला उद्यान कायार्लय, कौशाम्बी में माली या श्रिमकों के कुल िकतने पद सृिजत है। िजला उद्यान अिधकारी ने अपने बयान में यह स्वीकार िकया है िक वादी श्रिमक वषर्, 2008 से वषर्, 2011 तक आवश्यकतानुसार मस्टर रोल पर कायर् िकया है। सेवायोजक द्वारा दािखल सूची 11 बी/1 से श्री बच्चा लाल से संबंिधत मस्टर रोल प्रदशर् ई0-01 लगायत ई०- ई0-20 के अवलोकन से िविदत होता है िक वादी ने वषर् 2008 से जून, 2011 तक प्रत्येक कलेण्डर वषर् के प्रत्येक माह में 26 िदनों तक िनरन्तर कायर् िकया है। इस प्रकार वादी प्रत्येक कलेण्डर वषर् में 240 िदनों से अिधक का कायर् प्रितष्ठान में सेवारत रहते हुए िकया है। सेवायोजक द्वारा जब िविनयिमितकरण की कायर्वाही की जा रही थी, तो उन्हें श्रिमकों की विरष्ठता तथा कायर्काल के आधार पर

काय र ्त मस्टर रोल कमर्चािरयों की िवभागीय िनदेर्शानुसार सूची बनाकर िनयमानुसार िविनयिमितकरण की कायर्वाही करते, िकन्तु उनके द्वारा न तो िविनयिमितकरण हेतु तैयार की गई सूची प्रस्तुत की है और न ही यह स्पष्ट कर सके िक वादी का नाम िविनयिमितकरण सूची में रखा गया था या नहीं। वादी के न्यूनतम वेतन की मॉग से सेवायोजकों का असंतुष्ट / िखन्न होना स्वाभािवक है, इसिलए प्रकटतः उसे पुनः कायर् पर िनयोिजत नहीं िकया गया। वादी का अप्रैल, 2011 से जून, 2011 तक का पािरश्रिमक अभी भी सेवायोजक के पास प्रस्तुत कथनों तथा अिभलेखानुसार बकाया प्रतीत होता है। सेवायांजकों द्वारा वादी की सेवा समािप्त से पूवर् िनयमानुसार औद्योिगक िववाद अिधिनयम की धारा 6-एन का पालन नहीं िकया गया है। श्रिमक ने स्पष्टतः िनयोजक की अधीनता में एक वषर् से अिधक समय तक अनवरत सेवा की है, अत. िनयोजक द्वारा तब तक छटनी नहीं की जानी चािहए जब तक मजदूर को एक माह की िलिखत नोिटस िजसमें छटनी का कारण उिल्लिखत हो, न दे दी गयी हो तथा नोिटस की अविध न समाप्त हो गयी हो अथवा मजदूर को ऐसी नोिटस के बदले में नोिटस की अविध का वेतन न िदया गया हो। इसके साथ प्रत्येक वषर् में 06 माह से अिधक भाग के िलये वह पन्द्रह िदनों के औसत वेतन के समकक्ष प्रितकर प्राप्त करने हेतु भी अिधकृत था। वस्तुतः इस प्रािवधान का िनयोजक द्वारा पालन नहीं िकया गया।

उपरोक्त िववेचना के आधार पर में इस िनष्कष पर पहर् ुँचता हूँ िक वादी श्रिमक श्री बच्चा लाल पुत्र राम आसरे की सेवायें िदनाँक 01-12-2011 से समाप्त िकया जाना उिचत तथा/अथवा वैधािनक नही हं ै। वादी सेवा समािप्त की ितिथ से अिभिनणर्य प्रकाशन की ितिथ तक सेवा में रहत हे ुए यथावत दैिनक मजदूरी प्राप्त करता, को वतर्मान (दैिनक मजदूरी की दर से) वेतन पाने का अिधकारी होगा। सेवायोजको को िनदेर्िशत िकया जाता है िक वह वादी को सेवा में वतर्मान दैिनक मजदूरी दर पर पुनर्स्थािपत करते हुए िनयगानुसार िवभागीय िनदेर्शो के अनुरूप पात्रता पाये जाने पर िरक्त पद पर िविनयिमितकरण िकये जाने पर िवचार करें।

Questioning the said award, the respondents herein preferred Writ-C No.1777 of 2022 (State of U.P. and 3 others v. Presiding Officer Labour Court and 2 others) which came to be dismissed on 13.07.2023, order whereof is quoted hereinunder:

"Heard learned Standing Counsel for the State and Mr. Nikhil Chaturvedi, learned Counsel for the respondents.

By means of this present writ petition, the petitioners have assailed the award dated 26.03.2021 passed by the Presiding Officer, Labour Court, U.P., Prayagraj in Adj. Case No.53/2012 (Bachha Lal Vs. Incharge, Rajkiya Paudhshala, Kaushambi and another) as well as notice dated 11.11.2021 issued by the Deputy Labour Commissioner, Prayagra in R.D. Case No.01/2021 by which the the respondent no.3 has been reinstated as daily-wager labour.

Learned Standing Counsel submits that the respondent no.3 was working as a gardner on daily-wager basis from 2008 to 2011 as and when required and was paid for the period for which he had worked at the Rajkiya Paudhshala. He further submits that the respondent no. 3 was never appointed in the Rajkiya Paudhshala against any substantive post on daily-wager basis. The respondent no.3 of its own has left the job in the month of June, 2011 and have never returned for work in the Rajkiya

Paudhshala. He further submits that before the court below, respondent no.3 has not filed any document to show that he has worked for more than 240 days in a calendar year. He further submits that findings recorded by the court below in the impugned order are perverse and without any material. He further submits that the direction for reinstatement of the respondent no.3 is wrong and accordingly prays for allowing the present writ petition.

Rebutting to the said submission, counsel for the respondents submits that it is an admitted fact that the respondent no.3 was working as a gardner with the petitioners on daily wager basis from 01 January, 2008 to 31 June, 2011, but without issuing any notice, stopped the taking work from the respondent no.3 and therefore, rightly took the reference under Section 6N of U.P. Industrial Disputes Act, 1947. He further submits that the respondent no.3 has worked continuously without any break with the petitioners more than 240 days in a calendar year as required under Section 2G of the U.P. Industrial Disputes Act, 1947. He further submits that it is not in dispute that the petitioners has worked 240 days as it has been admitted by the petitioners who have filed the muster roll before the court below which clearly shows that respondent no.3 has worked 26 days in a month.

The said findings recorded in the impugned order have not been challenged by the petitioners in the present petition and prays for allowing the present petition.

Heard counsel for the parties and perused the record.

Admittedly, the respondent no.3 was engaged as a gardner in the Government Paudhshala and worked from 2008 till 2011. The respondent no.3 was paid on daily-wager basis and the payments were made which reflects from the muster roll filed by the petitioners before the court below. The court below on perusal of the muster roll has recorded the clear finding that the respondent no.3 worked in a month for 26 days without any break and therefore, held that the respondent no.3 worked for more than 240 days in a calendar year. The finding recorded in the order dated 26.03.2021 has not been challenged by the petitioner. Once finding of fact in favour of respondent no.3 has not been challenged in the present writ petition, no interference is called for in the impugned order.

In view of the aforesaid facts and findings of the present petition, the impugned order is correct and does not call for any interference of this Court.

Accordingly, the petition is hereby dismissed."

According to the learned counsel for the writ petitioner, the said order had attained finality. Thereafter the writ petitioner was accorded reinstatement by the District Horticulture Officer, District Kaushambi, respondent no. 3 on 20.12.2023 and the writ petitioner assumed the charge on 22.12.2023 and backwages have also paid to the writ petitioner on 25.03.2024. Since the writ petitioner's case for regularisation and payment of minimum of the minimum pay scale in terms of the judgement in Sabha Shanker Dube v. Divisional Forest Officer and others; (2019) 12 SCC 297 was not being accorded the same led to filing of the present petition.

This Court entertained the petition on 06.09.2024 and sought response.

A counter affidavit came to be filed by the first respondent by the Principal Secretary, Department of Horticulture and Food Processing, Government of U.P. dated 28.09.2024 and a supplementary counter affidavit filed on behalf of respondent nos. 1, 2 and 3.

Learned counsel for the writ petitioner has sought to argue that once the termination order dated 01.12.2011 came to be declared to be illegal by the Labour Court against which the writ petition came to be dismissed holding that the writ petitioner was a daily wager then the writ petitioner is entitled to be considered for regularisation and also minimum of the pay scale. Submission is that the writ petitioner had been working on daily wage basis from 01.01.2008 till 30.11.2011 and his engagement came to be ceased on 01.12.2011 and the Labour Court accorded reinstatement to the writ petitioner by virtue of the award dated 26.03.2021 along with the back wages and the back wages came to be paid to the writ petitioner and the writ petitioner, post dismissal of the petition so preferred by the respondents questioning the award passed by the Labour Court was reinstated in service on 20.12.2023 then the entire period from 01.01.2008 till the reinstatement is to be taken into consideration for the purposes of computing the period for regularization as well as for payment of minimum of the pay scale in the light of the judgement in Sabha Shanker Dube (supra) .

Sri B.K. Srivastava, learned Standing Counsel on the basis of the averments made in the counter affidavit and the supplementary counter affidavit has submitted that the writ petitioner is not entitled to be considered for regularization, particularly, when the writ petitioner's engagement was

purely on the basis of the availability of the work in the department and his status of casual labour and thus he had no lien against the post provided under Rule 9(13) of Clause II to IV, Part-II of the Financial Handbook and further the rules by the name of Uttar Pradesh (Outside the Purview of U.P. Public Service Commission) Group 'C' and Group 'D' Posts, Regularization Rules, 2016 according to him, the said rule does not apply to the writ petitioner as he was engaged purely only on the basis of the availability of work in the department adorning of the status of the casual labour. He further submits that the writ petitioner cannot be said to be a daily wager and further the cut of date so mentioned in Rule 6 being 31.12.2001 being the date from when the daily wager is to be engaged till the enforcement of the Rule. Contention is that the writ petitioner, as per his own saying, was engaged on 01.01.2008 i.e. much beyond the Rules. Further submission is that the writ petitioner is not entitled to payment of minimum of the pay scale as he is not completed the required engagement. Reliance has been placed upon the judgement in Secretary, Karnataka State v. Uma Devi; (2006) 4 SCC 1 .

I have heard learned counsel for the parties and gone through the records carefully.

Apparently, against the termination of the services on 01.12.2011, the writ petitioner approached the Labour Court and the Presiding Officer, Labour Court, Uttar Pradesh, Prayagraj in Adjudication Case No. 53 of 2011 declared the termination order dated 01.12.2011 as illegal and accorded reinstatement and directed the case of the writ petitioner to be considered for regularization. In the award itself a finding has been recorded by the Labour Court that the writ petitioner had worked for 26 years in a month and he was a daily wager after perusing the muster roll. The award of the Labour Court was subject matter of challenge by the respondents in Writ-C No. 1777 of 2022 and the said petition came to be dismissed on 13.07.2023 affirming the award of the Labour Court.

Plainly and simply, the finding so recorded by the Labour Court that the writ petitioner was a daily wager came to be endorsed by this Court in a writ petition preferred by the respondents herein.

On a pointed query being raised to the learned Standing Counsel whether the order passed in writ petition has been put to challenge, the answer is in

'Negative'.

Importantly, in the award of the Labour Court, it has been recited that the writ petitioner was performing the duties on daily wage basis since 01.01.2008 till 30.11.2011 and his services stood terminated on 01.12.2011 and post reference being made by the appropriate Government to the Labour Court award came to be passed in favour of the writ petitioner declaring the termination to be illegal and according reinstatement on 26.03.2021, however, post dismissal of the Writ-C No. 1777 of 2022 on 13.07.2023, the writ petitioner was reinstated in service by virtue of the order dated 20.12.2023 on 22.12.2023 and he was accorded back wages.

In paragraph-9 of the writ petition, the following has been asserted as under:

"9. That thereafter on 22.12.2023 the petitioner rejoined the service according to award dated 26.3.2021. The back wages of the petitioner was also paid by the respondent on 25.3.2024."

To which stands reply by a counter affidavit filed by the respondents in para-11, which reads as under:

"11. That the contents of paragraph no. 9 of the writ petition are not admitted in the manner, as stated hence denied. In reply thereto, it is submitted that the petitioner was never reinstated in service, rather in compliance of orders passed by the Hon'ble court he was permitted to work in the department as casual labour and in compliance of order dated 26.03.2021 of Labour court the government has issued a letter no. 09writ/58-2024-1779802 dated 01.02.2024, pursuance of which he was paid back wages."

Once, it is apparent from the record that the writ petitioner was engaged on daily wage basis on 01.01.2008 and he worked till 30.11.2011. His services stood terminated on 01.12.2011, award came to be passed on 26.03.2021 declaring the termination order to be illegal according reinstatement, writ petition whereof stood dismissed and the writ petitioner was reinstated on 22.12.2023 then the writ petitioner is entitled for computation of the services from 01.01.2008 for grant of benefits.

Now a further question arises as to whether the writ petitioner is entitled to the relief of regularisation or in terms of the 2016 Rules. As a matter of fact regularization is dependent upon the rules and an applicant in order to

claim consideration is to come within the cut of date, eligibility and suitability.

On a pointed query being raised to the learned counsel for the petitioner whether in terms of the 2016 Rules, the writ petitioner comes within the cut of date, Shri Nikhil Chaturvedi, learned counsel for the writ petitioner has fairly stated that as per the 2016 Rules so notified on 12.12.2016, the cut off date is 31.12.2001 but the petitioner engaged his post the said date on 01.01.2008, thus, he would be not considered for regularisation.

Coming to the next issue being the payment of minimum pay scale in the light of the judgement of the Hon'ble Apex Court in Sabha Shanker Dube (supra) , a conscious decision is to be taken by the respondents in that regard bearing in mind the services undergone by the petitioner and also the import, impact and the effect declaration of the termination order to be illegal and reinstatement of the petitioner in that regard.

As regard, the judgement in the case of Secretary, Karnataka State v. Uma Devi(supra) is concerned, there is no quarrel to the proposition of law but here in the present case, the claim of the petitioner for minimum of the pay scale is to be considered as per the Government orders issued from time to time.

Shri B.K. Srivastava, learned Standing Counsel at this juncture submits that the claim of the writ petitioner needs adjudication at the first instance by the second respondent, Director, Horticulture & Food Processing, U.P., Lucknow.

To such a submission, learned counsel for the petitioner has no objection and he gracefully accepts the same.

Considering the submissions of the rival parties as well as stand taken by them, the writ petition is being disposed off granting liberty to the writ petitioner to prefer a comprehensive representation along with the selfattested copy of the writ petition before the second respondent, who shall on the receipt of the same within a period of two weeks, proceed to decide the claim of the petitioner strictly in accordance with law within a period of two months from the date of presentation of the certified copy of the order. In case the second respondent is of the opinion that the matter is to be decided by some other authorities then the papers shall be transmitted to the same.
