Sri Shashi Bhushan Mishra, learned counsel for the applicant and Sri P.K.Srivastava, learned AGA, for the State, are present.

On 28.3.2026 Coordinate Bench of this Court passed the following order:

"1. Heard learned counsel for the accused-applicant, learned A.G.A. for the State and perused the material available on record.

2. This bail application has been moved on behalf of the accused-applicant/ Mukul for grant of bail, in Case Crime No. 482/2024, S.T. No. 415/2025, Under Section-137(2) BNS, Police Station Kithaur, District Meerut, during pendency of trial.

3. It has come in the statement of the victim recorded under Section 183 of Bhartiya Nagrik Suraksha Sanhita, 2023, that, applicant and other co-accused persons have abducted her from her doorstep and co-accused persons, namely, Rajni, Ravinder Bhati and Anu have raped her, one by one.

4. Investigation officer of the case, in question, shall appear in person on the next date of listing and shall also explain as to why, how and under what circumstances, the said statement of the victim recorded under 183 Bhartiya Nagrik Suraksha Sanhita, 2023, wherein she has given the detail of the offence of rape, was not carefully considered, and the said explanation be submitted by way of filing his personal affidavit.

5. List on 13th April, 2026 as fresh. "

Considering the order dated 28.3.2026 passed by Coordinate Bench of this Court, in view of this Court, the instant mater should be placed before the same Bench, who passed the above order.

Put up this case again as fresh on 23.4.2026 before appropriate Court.
