Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material on record.

By means of this application, the applicant who is involved in Case Crime No. 367 of 2025, under Sections 109(1), 351(3), 352 and 3(5) of B.N.S., P.S. Bhagatpur, District Moradabad, is seeking enlargement on bail during the trial.

Learned counsel for the applicant submitted that the applicant is absolutely innocent and has been falsely implicated in the present case due to some ulterior motive. He next submitted that in the first information report the allegation of physical assault upon the victim by axe has been leveled against four persons, including applicant. No specific role has been recovered either from the applicant or on his pointing out. He further submitted that no incriminating article or material has been recovered either from the applicant or on his pointing out. He lastly submitted that the applicant, who is in jail since 15.1.2026 and has no criminal antecedents to his discredit is entitled to be enlarged on bail during pendency of the trial.

On the other hand, learned A.G.A. has vehemently opposed the prayer for bail and submitted that in the F.I.R. itself it is alleged that the applicant-accused has assaulted the victim/injured person. He further submitted that, as per report of NCCT Head (page no. 44 of the paper book) : Superatentorial Region: Few illdefined hyperdense areas are noted in bilateral frontal convexities, left parietotemporal, largest of

them measuring 1.5 x 1.4 x 1.3 cm s/o Hemorrhagic contusion. Mild perilesional edema is noted. Few associated air foci noted. SDH component noted along falx. A crescent shaped hyper density is noted in the left temporal region for maximum thickness measuring 5 mm. Undisplaced fracture of palatine process of the maxilla and median palatine suture. Fracture of bilateral frontal sinus, right supraorbital region and frontal bone in midline and on left side. Fracture of nasal bone. No evidence of any focal parenchymal lesion is noted and in view of the above, the accused-applicant is not entitled to be enlarged on bail.

After having heard the learned counsel for the applicant, learned A.G.A. for the State and perused the record, this Court is not inclined to enlarge the applicant on bail during the trial, hence this bail application is rejected.
