Heard Shri Sumit Chauhan, learned counsel for the applicant and Shri Mohd. Asif Khan, learned Additional Government Advocate and perused the file.

Present application has been filed by the applicant seeking bail in Case Crime No. 44 of 2025, under Section 3/8 of Uttar Pradesh Prevention of Cow Slaughter Act, registered at Police Station-Naveen Modern, DistrictShravasti.

In the FIR dated 23.06.2025, it has been alleged that certain parts of cattle were found in a sugarcane field. The applicant was arrested by the police in an alleged encounter in FIR No. 47 of the year 2025. In the statement given while in custody in the said case, the applicant admitted his involvement in the present case.

In the affidavit filed along with the application, it has been stated that the applicant has been shown to be involved in six other criminal cases, in all of which the applicant has been enlarged on bail.

It has also been submitted that co-accused Munnauwar @ Ata Mohd. has already been enlarged on bail by the Co-ordinate Bench of this Court vide order annexed as Annexure No. 3 to the bail application. Applicant seeks parity with the bail order of the said co-accused.

Learned AGA for the State opposed the application and submitted that the allegations have been confirmed during investigation and that the charge

sheet was submitted on 31.08.2025.

Upon due consideration of the facts that there is no named accused and no eyewitness in the present case; that the applicant has admitted his involvement in the present case in a statement given while in custody after being arrested in an encounter in another case; that the applicant has been languishing in jail since 30.06.2025; that there is no incriminating material against the applicant; and that the charge sheet has already been filed, I find it to be a fit case for enlarging the applicant on bail on the ground of parity.

Accordingly, the bail application is allowed on the ground of parity.

Let the applicant- Chore @ Munsareef, involved in aforesaid case crime be released on bail on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:-

(i) the applicant shall not tamper with the prosecution evidence;

(ii) the applicant shall not pressurize the prosecution witnesses;

(iii) the applicant shall appear on each and every date fixed by the trial Court.

Any other condition(s) which the trial court/concerned court may deem fit and proper, in the circumstances of the case, may also be imposed.

It is clarified that the observations made in this order are confined to the present bail application and shall have no bearing on the merits of the trial.
