Heard Sri Atul Verma, the learned counsel for the applicant and Sri Anurag Kumar Singh, the learned counsel for the respondent-CBI.

The learned counsel for the CBI has filed a counter affidavit and the learned counsel for the applicant has filed a rejoinder affidavit. Both the affidavits are taken on record.

The aforesaid case has been registered on the basis of an FIR lodged on 28.12.2018 against 6 named persons, not including the applicant, and 10 to 12 unnamed persons, stating that the applicant was engaged in real estate business. One of the named accused persons Atiq Ahmad, former M.P., was lodged in Deoria Jail. He had been exerting pressure on the complainant through his henchmen for extorting money from the complainant. The complainant had paid some amount but thereafter when he stopped paying him money, he was taken to Atiq Ahmad lodged in Deoria Jail and he was beaten up badly inside the jail due to which he suffered fracture in his fingers and had suffered numerous internal injuries.

In the affidavit filed in support of the bail application it has been stated that the appellant was involved in Case Crime No. 360 of 2015, under Section 302/34 IPC, Police Station Jataha Bazar, District Kushinagar wherein he was convicted and sentenced to life imprisonment. This case

was based on the allegation that the applicant had killed his wife. Criminal Appeal No. 663/2025 filed by the appellant against the conviction order has been admitted and the appellant has been granted bail by means of an order dated 14.05.2025. The applicant is not involved in any other case. The applicant has been implicated in the present case while he was lodged in jail in connection with the aforesaid case crime No. 360 of 2015.

The learned counsel for the applicant had stated that as many as five prosecution witnesses have already been examined. The complainant has stated the applicant was also amongst the persons who had beaten him in the jail. The other persons involved in the incident were identified by the applicant as Mohd. Umar, Zaki Ahmad, Gulam Moinuddin Siddiqui, Hamza Ansari, Palakat Ali, Zafar, Amir Quraishi, Alamgeer (the applicant), Mukhtar Yadav and Gulam Sarvar alias Chand, Dayanand, Pawan Kumar and Irfan. Out of the aforesaid persons, Mohd. Umar, Zaki Ahmad, Gulam Moinuddin Siddiqui, Gulam Sarvar alias Chand, Dayanand, Pawan Kumar and Irfan have already been enlarged on bail and copies of their bail orders have been annexed with the bail application.

Although the learned counsel for the respondent-CBI has opposed the bail application, he could not dispute the fact that seven accused persons have already been enlarged on bail and the allegations levelled against the applicant are similar to those levelled against the other accused persons who have been enlarged on bail.

Keeping in view the aforesaid facts, I am of the view that the applicant is also entitled to be enlarged on bail on the ground of parity.

Accordingly, this bail application stands allowed .

Let the applicant- Alamgeer be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to the following conditions: -

(i) the applicant shall not tamper with the prosecution evidence;

(ii) the applicant shall not pressurize the prosecution witnesses;

(iii) the applicant shall appear on each and every date fixed by the trial court.
