यािचकाकतार् के िवद्वान अिधवक्ता श्री मनीष वैश , िवद्वान अपर शासकीय अिधवक्ता श्री मयंक िसन्हा तथा भारत संघ के िवद्वान अिधवक्ता श्री वरुण पांडेय को सुना तथा पत्रावली का अवलोकन िकया।

भारतीय संिवधान के अनुच्छेद 227 के अन्तगर्त प्रस्तुत इस यािचका द्वारा यािचकाकतार् ने िवद्वान अपर मुख्य न्याियक मिजस्ट्रेट (पंचम), लखीमपुर खीरी को यािचकाकतार् के पोसपोटर् प्राप्त करने की अनुमित देने के िनदेर्श देने के िलए प्रस्तुत की, िकन्तु पूरी यािचका में कहीं भी उस वाद संख्या का उल्लेख नहीं है, िजसके संबंध में न्यायालय को िनदेर्श देना है।

ऐसी पिरिस्थित में िबना वाद संख्या के न्यायालय को कोई िनदेर्श देना संभव नहीं है।

तदनुसार, यािचका िनरस्त की जाती है।

योिचकाकतार् को सही िववरण के साथ नवीन यािचका प्रस्तुत करने की अनुमित दी जाती है।

यािचका के साथ संलग्न प्रमािणत प्रितयां, छाया-प्रितयां अिभलेख पर रखते हुए यािचकाकतार् के िवद्वान अिधवक्ता को वापस कर दी जाएं।
