Allahabad High Court (Lucknow Bench), WRIT - C No. 9675 of 2025 (Subhash Vidyarthi, J.; order dated October 13, 2025): Lal Bahadur Yadav, Village Pradhan, challenged the District Magistrate, Sultanpur's order dated 12.09.2025, whereby, on a preliminary investigation report into complainant Mahendra Pratap Singh's complaint alleging misuse of Rs.1,67,800/- of government funds and breach of government orders and financial rules, final investigation was instituted against him and all his financial and administrative powers as Pradhan were suspended. The allegations concerned reboring of an India Mark-2 handpump recorded at the wrong house (Bhagwat Singh instead of Sunil Singh), and expenditure of Rs.29,200/- (10 handpumps, 2022-2023) and Rs.30,600/- (9 handpumps, 2021-2022) on a complaint lodged in 2025. From the Chief Standing Counsel's statement that the charge sheet (printed as dated 08.10.2023) followed institution of final investigation, the court recorded that the inquiry was not completed within the six-month period prescribed by the applicable rules, the preliminary inquiry alone having concluded after nine months. इस प्राथर्ना पत्र द्वारा िशकायतकतार् ने पक्षकार बनने का अनुरोध िकया है। यािचकाकतार् ने िशकायतकतार् के िवरुद्ध कोई अनुतोष नहीं मांगा है तथा िशकायतकतार् प्रकरण में आवश्यक पक्षकार नहीं है, न्यायिहत में िशकायतकतार् को प्रकरण में हस्तक्षेप करने एवं तकर् प्रस्तुत करने की अनुमित दी जाती है।

प्राथर्ना पत्र तदनुसार िनस्तािरत िकया जाता है।

यािचका पर आदशे

यािचकाकतार् के िवद्वान अिधवक्ता श्री अिमत कुमार िसह भदौिरया, िवद्वान मुख्य स्थायी अिधवक्ता श्री सुनील कुमार खरे तथा िशकायतकतार् की तरफ से श्री महेनद्र प्रताप िसह को सुना तथा पत्रावली का अवलोकन िकया।

इस िरट यािचका द्वारा यािचकाकतार् ने िजला मिजस्ट्रेट सुलतानपुर द्वारा पािरत आदेश िदनांक 12.09.2025 की वैधता को चुनौती दी है, िजसके द्वारा िशकायतकतार् महेन्द्र प्रताप िसह की िशकायत पर संिस्थत प्रारंिभक जाँच आख्या के आधार पर यािचकाकतार् को अपने पदीय दाियत्यों एवं कतर्व्यों का िनवर्हन सुचारू रूप से न करने तथा शासकीय धनरािश रु०1,67,800/- का दुरुपयोग करने, शासनादेशों तथा िवत्तीय िनयमों का पालन न करने आिद के िलए दोषी पाते हुए उसके िवरुद्ध अिन्तम जाँच संिस्थत की गई तथा यािचकाकतार् के प्रधान पद के समस्त िवत्तीय एवं प्रशासिनक अिधकारों के सम्पादन पर रोक लगा दी गई।

आलोच्य आदेश में अंिकत है िक यािचकाकतार् के िवरुद्ध तीन आरोप लगाए गएः-

प्रथम आरोप यह है िक उसने श्री भगवत िसह के दरवाजे़ पर इंिडया माकार्-2 हैण्डपम्प के िरबोर कराने के मद में खचर् करना िदखाया जबिक जाँच में यह तथ्य प्रकाश में आया िक भगवत िसह के दरवाजे़ पर िस्थित हैण्डपम्प िरबोर न करवाकर सुनील िसह के दरवाजे़ पर िस्थित हैण्डपम्प का िरबोर कराया गया। यािचकाकतार् ने अपने स्पष्टीकरण में गलत नाम त्रुिटवश अंिकत करना कहा तथा यह कहा िक हैण्डपम्प का िरबोर वास्तव में कराया गया।

िद्वतीय आरोप वषर् 2022-2023 में 10 हैण्डपम्पों की मरम्मत हेतु रु०29,200/- रुपये व् य करने के संबंध में था।

तृतीय आरोप वषर् 2021-2022 में 9 हैण्डपम्प की मरम्मत हेतु रु०30,600 /- व् य करने के संबंध में था, जबिक िशकायत वषर् 2025 में प्रस्तुत की गई ।

यािचकाकतार् के िवद्वान अिधवक्ता ने तकर् िदया िक वषर् 2021-2022 तथा 2022-2023 में हैण्डपम्पों की मरम्मत के िबना व् य करने का आरोप िनराधार है तथा वषर् 2025 में यह आरोप द्वेषवश लगाया गया है।

यािचकाकतार् के िवद्वान अिधवक्ता ने दूसरा तकर् यह िदया िक सुनील िसह के घर के सामने हैण्डपम्प का िरबोर कराने एवं नाम त्रुिटवश भगवत िसह अंिकत कराने मात्र से यािचकाकतार् के िवत्तीय एवं प्रशासिनक अिधकारों पर रोक लगाना उिचत नहीं होगा, जबिक कायर् वास्तव में कराया गया है।

यािचकाकतार् के िवद्वान अिधवक्ता ने यह भी तकर् िदया िक संगत िनयमों के अनुसार िशकायत प्राप्त होने की ितिथ से छः माह के अन्दर कायर्वाही पूणर् कर ली जानी चािहए, जबिक प्रस्तुत प्रकरण में 9 माह पश्चात मात्र प्रारिम्भक जाँच पूरी हुई है। इस तकर् के उत्तर में िवद्वान मुख्य स्थायी अिधवक्ता ने कहा िक अंितम जाँच संिस्थत होने के पश्चात यािचकाकतार् को आरोप पत्र िदनांक 08.10.2023 को िनगर्त िकया गया है। अतः िवद्वान मुख्य स्थायी अिधवक्ता के कथन से यह स्पष्ट है िक जाँच की कायर्वाही संगत िनयमों में िदए गए समयानुसार पूरी नहीं की गई है।

प्रकरण की िवस्तृत समीक्षा की आवश्यकता प्रतीत होती है।

िवपक्षीगण 4 सप्ताह में प्रित शपथ पत्र प्रस्तुत करना सुिनिश्चत करें।

प्रत्युत्तर शपथ पत्र तदुपरान्त दो सप्ताह में प्रस्तुत िकया जाए।

यह यािचका िदनांक 05.01.2026 से प्रारंभ होने वाले सप्ताह में सूचीबद्ध हो।

13.अगली ितिथ तक आलोच्य आदेश िदनांक 12.09.2025 का िक्रयान्वयन, जहाँ तक यह यािचकाकतार् के प्रशासिनक एवं िवत्तीय अिधकारों पर रोक लगाता है,स्थिगत रहेगी तथा यह स्पष्ट िकया जाता है िक यािचकाकतार् के िवरुद्ध अिन्तम जाँच की कायर्वाही स्थिगत नहीं की गई है।
