In response to our order dated 29.01.2025, Shri Tushar Mittal, learned Counsel appearing for the opposite party no. 8 says that there is an examination center at Gonda i.e. the place where the petitioner is presently lodged in jail. Now, the petitioner, Chandni Shukla @ Chandni, D/O - Late Ashok Kumar Shukla, is lodged in jail at Gonda in connection to Case Crime No. 258 of 2023 under Sections 389, 504 & 506 I.P.C. and Case Crime No. 841 of 2024 under Sections 120-B, 419, 420, 447, 467, 468 & 471 of Indian Penal Code registered at Police Station - Kotwali Nagar, District - Gonda. She has already completed B.A. L.L.B. Second Semester and has also studied for the third semester, till she was incarcerated in connection with the aforesaid cases. She now wants to appear in the B.A. L.L.B. (5 year Course) third semester examination which are scheduled to be held from 07.02.2025.

Be that as it may, it is provided that the petitioner shall be taken in police custody to appear for examination at the examination center at Gonda which shall be communicated to the petitioner and the Superintendent of Police, Gonda and the Senior Superintendent of District Jail, Gonda. The Counsel for the opposite party no. 8 has very fairly submitted that he will intimate to the opposite party no. 7 College from where the admit card is to be issued to the petitioner for appearing in the said examination about the examination center of the petitioner which shall be at Gonda.

In view of the aforesaid, we direct the opposite party no. 7 to allow the sister of the petitioner who has filed the affidavit in support of the writ petition to collect the admit card of the petitioner from the opposite party no. 7, and thereafter, petitioner shall be taken in police custody to appear at the

examination center at Gonda for the B.A. L.L.B. (5 year Course) third semester examination, as and when the examinations are scheduled. The opposite parties no. 4 & 5 are directed to make suitable arrangements so as to facilitate the aforesaid exercise, and also, that the petitioner remains in police custody, till she is lodged back in jail after the examination.

Shri Rajdeep Singh, learned A.G.A. shall communicate this order to opposite parties no. 4 & 5 for compliance. The sister of the petitioner shall provide schedule of the examination which may be mentioned in the admit card or otherwise, to the opposite party no 5.

The writ petition is accordingly disposed of.
