Petitioner seeks execution of free hold lease in respect of Plot No.C-2/143, Sector-B, Sitapur Road Yojana, Lucknow by the Lucknow Development Authority.

Learned counsel for L.D.A. says that allotment was in the name of one Sri Ranjan. Initially, an amount of Rs.500/was paid by one Smt. Krishna. Thereafter, the requisite amount was paid by Sri Ranjan. But the petitioner claims to have lease deed in his favour in respect of the same plot without explaining as to how the said lease deed came to be executed in his favour. The original file of the L.D.A. is missing. A duplicate file has been constituted and it does not contain any allotment letter in favour of the petitioner herein.

On being confronted, learned counsel for the petitioner submits that he does not have the original allotment letter but the said allotment letter is mentioned in the lease deed copy of which is annexed as Annexure no.1. According to him, the lease deed refers to an allotment letter dated 03.05.1988.

Be that as it may, let the Vice-Chairman, Lucknow Development Authority get the facts verified from the records especially the veracity of the lease deed and then take a decision as regards entitlement of the petitioner to get a freehold lease in his favour by the L.D.A. but with expedition say within two months. The decision taken shall be communicated to the petitioner also.

Accordingly, the petition is disposed of.
