Heard learned counsel for the petitioners and learned Standing counsel for the State and Shri Karunakar Srivastava, learned counsel for the respondent nos. 2 and 3.

By means of this petition, the petitioners have prayed for the following relief :

" (i). issue a writ, order or direction in the nature of mandamus commanding the opposite party no.3, Executive Officer, Nagar Panchayat, Mankapur, Gonda District Gonda to decide the application for mutation dated 28.03.2025 moved by the petitioners for substituting their name in Municipal records at the House No.2 and House No.71, situated at Rajendra Nagar, Mankapur Gonda, District Gonda pending before him since 28.03.2025 expeditiously within stipulated time prescribed by this Hon'ble Court as contained in Annexure no. 3 in this writ petition in the interest of justice."

Learned counsel for the respondent nos. 2 and 3 on the basis of instructions states that the step grandmother of the petitioners has also raised a plea for mutation of the property in dispute on the basis of a registered will deed. Copy of the application made by Smt. Gulab Devi, Wife of Mangli Prasad has been produced before this Court along with the copy of the registered will deed, the same is kept on record along with the application of Smt. Gulab Devi, Wife of Mangli Prasad.

It is evident from the pleadings on record that the application moved by the Petitioners for mutation dated 28.03.2025 is still pending before the respondent nos.2 and 3. There is no reason to keep such application pending and also the application of Smt. Gulab Devi, Wife of Mangli Prasad, moved on 06.05.2025 by her.

This writ petition is disposed of with a direction to the respondent No.3 to decide both the mutation applications together by giving opportunity of hearing to all concerned within a period of six weeks from the date a certified copy of this order is produced before him.
