Heard learned counsel for the petitioners and learned counsel for the respondents.

The case of the petitioners is that petitioner no.2 has been engaged under U.P. Rajya Gramin Ajeevika Mission as Vidyut Sakhi for collecting electricity bills in the rural area by order dated 06.03.2024. Pursuant to the said order, petitioner no.2 started collecting electricity bills in the rural area which is evident from the list appearing on page 27 of the writ petition in which name of petitioner no.2 is appearing at serial no.8.

It appears that thereafter, Director (Commercial), Maschimanchal Vidyut Vitran Nigam Ltd., Meerut passed an order on 07.11.2024 directing that cash counter which were run by employees of T.G.-2 department may be replaced by Fintech Agency (RANPAY. SARAL.BLS. SAHAJ & VAYAMTECH & CSC. The petitioner no.2 collects electricity dues and deposit the same with CSC which is the parent body of the petitioner no.2, and since, CSC was also allowed to collect electricity dues, therefore, petitioner no.2 had no grievance against the order dated 07.11.2024. However, under the garb of the order dated 07.11.2024, respondent-authority arbitrarily without giving any notice and opportunity of hearing and without any rhyme and reason restrained the petitioner no.2 from collecting electricity dues in the rural area.

It is submitted that respondent no.3 is sitting tight over the matter and has not yet taken any decision on the representation of the petitioner no.2.

Considering the facts and circumstances of the case and without adverting into the merits of the case, we dispose off the writ petition permitting the petitioners to file a detailed representation alongwith certified copy of this order raising all their grievances before the respondent no.3-Chief Executive Engineer, Pashchimanchal Vidyut Vitran Nigam Ltd. Moradabad Mandal, Moradabad within a period of two weeks from today. In case, any such representation is filed by the petitioners, the respondent no.3 shall consider and decide the same in accordance with law after giving due notice and opportunity of hearing to the petitioners within a period of two weeks from the date he receives the representation of the petitioners.
