1. The instant petition has been filed by the petitioners challenging the order dated 20.11.2024 passed by District Magistrate, Varanasi in purported compliance of the directions given by order dated 3.5.2024 in the previous writ petition of the petitioners, bearing number 25489 of 2019.

On 9.1.2025, we passed an order granting liberty to respondent no. 2 to revisit the matter.

Respondent no. 2 has filed his affidavit and has annexed therewith an order dated 20.1.2025 by which he has revisited the controversy. By the fresh order dated 20.1.2025, he has issued directions for payment of compensation for the land in dispute to the petitioners at the rate of Rs. 7,500/- per sq. meters, in respect of Arazi Nos. 555 and 557, area 850 sq. meters.

Counsel for the petitioners submitted that in identical facts and circumstances, the respondents obtained sale deed from Kamlesh Kumar Singh in the year 2018 and also paid compensation to him at the rate of Rs. 7,500/- per sq. maters. The petitioners are therefore entitled to interest at least from the year 2018, when compensation at the said rate was paid to Kamlesh Kumar Singh.

We are of the opinion that the aspect relating to payment of interest should be examined by respondent no. 2 while paying compensation to the petitioners in pursuance of order dated 20.1.2025.

Accordingly, the petition is disposed of with direction to the respondents to pay compensation to the petitioners in terms of order dated 20.1.2025 expeditiously and also consider their request for payment of interest since the year 2018. The said exercise shall be completed within six weeks from today.
