1. The present petition has been filed by the petitioner, who seeks renewal of his passport. The difficulty coming in his ways the pending Case Crime No. 0218 of 2022 registered against him under Sections 295-A I.P.C. and Section 67 of the I.T. Act, P.S.- Shergar, District- Bareilly.
2. This Court has already had an occasion to deal with the similar situation and in Pawan Kumar Rajbhar vs. Union of India and 2 Others (Neutral Citation No. 2024: AHC: 9963DB), as per the guidelines laid down, the petitioner shall move an appropriate application before the trial court concerned and if the said application is allowed by the trial court, he shall be permitted to move an application before the Passport Authority, which shall consider the same. However, we would like to add that once passport has been issued, the same shall be deposited before the trial court and application shall be moved by the petitioner as and when he is required to travel abroad, which shall be decided independently by the trial court and if so in favour of the petitioner, it shall be released by the court concerned.
