Heard Sri Jitendra Saksena, the learned counsel for the petitioner, Sri Pankaj Srivastava, the learned Additional Chief Standing Counsel for the State of U.P., Sri Vaibhav Gupta, the learned counsel for the opposite party no. 2-Uttar Pradesh Basketball Association, Sri Sumit Kumar Srivastava and Sri Diwakar Singh Kaushik, the learned counsel for the opposite party no. 3-Lucknow District Basketball Association.

By means of the instant petition filed on 11.11.2025, the petitioner has prayed for cancelling the upcoming election of the opposite party no. 2-society scheduled to be held on 08.11.2025. The election has already been held on 11.11.2025.

The learned counsel for the petitioner states that he does not want to press the instant petition and he seeks liberty to institute appropriate proceedings challenging the validity of the elections before the Deputy Registrar under Section 25(2) of the Societies Registration Act.

Accordingly, the writ petition is dismissed with the aforesaid liberty to institute such proceedings afresh.
