The instant petition under Article 226 of the Constitution of India has been filed by the petitioner with a prayer to remove illegal encroachment made by opposite parties no. 6 to 13 over Gata No.549, area 0.1640 hectare, and Gata No.563, area 0.7590 hectare, which is recorded in the revenue record of the village as Baba Bholenath Ji Ki Kuti and Khalyan, respectively.

Learned counsel for the State respondent submits that as per instructions received from the Tehsildar, no encroachment has been found on the Gata No.549 and the land is vacant, whereas illegal construction in the possession of respondents nos. 8, 11, 12, and 13 has been found on Gata No. 563, area 0.7590 hectare, about which proceedings have been initiated under Section 67 of the UP Revenue Code, 2006.

Learned Standing Counsel submits that 25/11/25 is fixed for proceedings under Section 67 of the UP Revenue Code.
