Shri Sumeet Tahilramani, Advocate holding brief of Shri S.M. Singh Royakwar, learned counsel for Pharmacy Council of India/respondent no. 2, Shri Atul Kumar Dwivedi, learned counsel for Dr. A.P.J. Abdul Kalam Technical University, U.P./respondent no. 3 and perused the material available on record.

By means of the present writ petition, the petitioner has prayed for a direction in the nature of Mandamus commanding the respondent no. 3/Dr. A.P.J. Abdul Kalam Technical University to grant affiliation to the petitioner institution for B.Pharma Course in respect of the academic sessions 2025-26 against 60 seats.

Submission of learned counsel for petitioner is that petitioner-institution was granted approval by the respondent no. 2 on 22.08.2025. He further submits that after obtaining the said approval from Pharmacy Council of India, the petitioner-institution applied for affiliation on 06.11.2025.

The contention of learned counsel for petitioner is that since then the case for grant of affiliation is pending with respondent University.

In response to the above, Shri Atul Kumar Dwivedi, learned counsel for Dr. A.P.J. Abdul Kalam Technical University/respondent no. 3 submits that the State of U.P. vide Government Order dated 31.10.2025 has prescribed the procedure for grant of affiliation to the institutions. As a consequence thereof, the application submitted by the petitioner college on the online official portal was scrutinized by the duly

constituted Scrutiny Committee and thereafter the same has been forwarded to the District Magistrate, Ayodhya for further process. He states that the said report of the District Magistrate, Ayodhya is still awaited.

On being asked as to why the aforesaid report has not yet been sent by the District Magistrate, Ayodhya till date, Shri Badrish Kumar Tripathi, learned Additional Chief Standing Counsel appearing for the State-respondent no. 1, on the basis of oral instructions received by him from the District Magistrate, Ayodhya submits that the said report will be sent to the University/respondent no. 2, today itself.

In view of the aforesaid situation, this Court is of the considered view that no useful purpose would be served in keeping the present writ petition pending, accordingly, this petition is disposed of with a direction to the District Magistrate, Ayodhya as well as Dr. A.P.J. Abdul Kalam Technical University U.P. to make serious endeavour to take decision on the afore-mentioned petitioner's application keeping in view the cut off date i.e., 15.11.2025 fixed by the Hon'ble Supreme Court of India in the case of Parshwavanath Charitable Trust Vs. All India Council for Technical Education and others passed in C.A. No. 9048 of 2012 .

With the aforesaid observations/directions, the instant writ petition is disposed of .

Let a certified copy of this order be furnished to the learned counsel for petitioner on payment of usual charges as well to learned Additional Chief Standing Counsel for the State and Shri Atul Kumar Dwivedi, learned counsel for Dr. A.P.J. Abdul Kalam Technical University U.P. free of cost today itself, for necessary compliance.
