Petitioners led by Dev Narayan Pandey, statedly engaged in service on various dates from 1991 till 1995 and serving as Block Commander, PRD, District Bahraich, sought a direction that they not be disengaged, alleging oral dispensation from service without notice despite long years of service, and adverted to letters and identification cards. On instructions it was submitted they had been given opportunity to apply afresh for continued engagement as Prantiya Raksha Dal volunteers subject to fulfilling criteria. Heard learned counsel for petitioners and learned State Counsel appearing on behalf of opposite parties.

Petition has been filed seeking a direction to concerned authority to not disengage petitioners from the post of Block Commander, PRD, District Bahraich.

It has been submitted that petitioners were engaged in service on various dates from the years 1991 till 1995. He has also adverted to various letters and identification cards issued to petitioners to corroborate petitioners' engagement in service and continued discharge of duties. It is also submitted that despite petitioners having rendered long years of service, they have been dispensed with from service orally without notice.

On the basis of instructions, learned counsel for petitioners submits that petitioners have given opportunity for application before authority concerned for continued engagement as volunteer of the Prantiya Raksha Dal in case fulfill all the criteria.

Considering innocuous prayer being made by learned counsel for petitioners and without entering into the merits of the case, petitioners are granted liberty to file a fresh individual representation before opposite party No.2 i.e. District Magistrate, Bahraich or any competent authority for their continued engagement on relevant post. In case such a representations are filed, the said authority is required to consider the same within a period of six weeks from the date a certified copy of this order is produced before the

said authority.

With the aforesaid observation, petition stands disposed of .
