Heard learned counsel for the petitioners and learned State Counsel appearing on behalf of opposite parties.

Present petition under Article 226 of Constitution of India has been filed seeking direction to authority concerned for payment of consequential benefits of service to petitioners since their initial appointment dated 06.02.2009 till the date of actual joining on 21.04.2018 in compliance of judgment and orders of this Court dated 13.04.2015 and 14.12.2017.

Learned counsel for petitioner submits that earlier petitioners had been appointed on the post of Sweeper in pursuance of advertisement issued but their appointment was subsequently cancelled on 07.02.2009 leading to filing of Writ Petition No.1709(S/S) of 2009 which was disposed of vide judgment and order dated 13.04.2015 directing authority concerned to consider case of petitioners for appointment against 18 vacancies on the said post.

Representations made in pursuance of aforesaid order were thereafter rejected leading to filing of Writ Petition No.5664(S/S) of 2015 which was allowed by means of judgment and order dated 14.12.2017 directing the District Panchayat Raj Adhikari, Pratapgarh to pass fresh orders in accordance with the directions given by this Court earlier. It is submitted that subsequently in pursuance of Contempt Application no.473 of 2018, petitioners were given appointment on the said post on 16.04.2018 but the benefits which they are claiming have not been provided to them leading to raising of their grievance by means of representation dated 29.04.2025 which is under active consideration.

Learned counsel for petitioners at present restricts prayer for decision on representation of petitioners.
