Heard learned counsel for the appellant and learned A.G.A. for the State.

This Criminal Appeal under Section 14-A (2) Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act has been preferred against the impugned order dated 09.06.2025 passed by Special Judge, Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, Ambedkarnagar in Bail Application No. 1144 of 2025: Pradeep Kumar Vs. State, arising out of Case Crime No. 340 of 2025, under Section 191(1), 319(2), 318(3), 115(2), 352, 351(3), 333, 324(4), 75, 329(4), 140(2), 3(5) BNS and Section 3(2) (v), 3(2) VA, 3(1) DA, DHA, SC/ST Act, Police Station Kotwali Akbarbpur, District Ambedkarnagar, whereby the bail application of the appellant has been rejected.

Learned Counsel for the State could not inform whether the notices have been served upon the victims, as mandated by Section 15A(3) of the SC-ST Act, or not.

From perusal of the impugned order, prima facie, the allegations are with regard to wrongful execution of an agreement to sell at the instance of the appellant, prima facie, the allegations are of civil in nature.

Considering the fact that the appellant has no criminal antecedent, as an interim measure, the appellant is enlarged on interim bail, subject to hearing the victim.

The appellant shall be enlarged on interim bail by the court concerned on his furnishing two sureties, to the satisfaction of the court concerned.

List this case on 20.08.2025.

The order shall be passed finally on the appeal after hearing both the parties.

In the meanwhile, learned A.G.A. may serve the copy of this appeal to the opposite party No.2.
