Learned counsel for the petitioner, at the very outset, states that he is aggrieved by the order dated 01.04.2019, a copy of which is annexure 1 to the writ petition, whereby the claim of the petitioner against a class III post had been rejected at that stretch of time on the ground that there were no vacant post available and that the claim of the petitioner would be considered in case any vacancy is available.
Subsequent thereto vacancy on class III post has arisen as is also admitted by Shri Shiv Prasad Kushwaha, learned counsel for the respondents no. 3 & 4 on the basis of instructions sent by respondent no. 4.
Considering the aforesaid, the writ petition is disposed of leaving it open to the respondents no. 3 and 4 to consider the claim of the petitioner for appointment on a class III post.
Let such consideration be made in accordance with law and relevant rules within a period of 8 weeks from the date of receipts of a certified copy of this order.
It is made clear that this Court has not gone into the merits of the claim set forth by the petitioner.
