Herard Sri Akhilesh Kumar, learned counsel for the petitioner, Sri Shailesh Srivastava, learned standing counsel for the state-respondents and Sri Pradeep Singh, learned counsel for the respondent-gaon sabha.

Counsel for the petitioner submitted that in the proceeding under Sections 33/39 of the U.P. Land Revenue Act, an order was passed for restoring the entry of pond in respect to plot no.151. He submitted that in the proceeding under Sections 33/39 of the U.P. Land Revenue Act, it has been found that the decree under Section 229-B of the U.P. Z.A. & L.R. Act set up by the private respondent is forged. He submitted that Writ C No.31604/2005 filed by the private respondent against the order dated 4.3.205, passed by the S.D.O., under Sections 33/39 of the U.P. Land Revenue Act, was dismissed on 22.2.2023 and the order has attained finality but the authorities have not taken steps for restoring the plot in question as pond, as such, appropriate direction be issued for removal of encroachment from the plot in question.

Sri Shailesh Srivastava, learned standing counsel and Sri Pradeep Singh, learned counsel for the respondent-gaon sabha shall obtain instructions in the matter within 2 weeks.
